ISLAMIC JURISPRUDENCE – PART 2 (THE SOURCES OF ISLAMIC LAW)

There are 2 sources of Islamic Law:

1. Main Sources
2. Interpreted Sources

Main Sources

1. Holy Quran
2. ‘As-Sunnatun Nabawiyah’ (Prophetic Traditions)

Among the proofs of the Main Sources are:

1. Allah s.w.t. says in the Holy Quran which means,

“O ye who believe! Obey Allah, and obey the Messenger, and those charged with authority among you. If ye differ in anything among yourselves, refer it to Allah and His Messenger, if ye do believe in Allah and the Last Day: That is best, and most suitable for final determination.”

[Chapter An-Nisa’: Verse 59]

“So take what the Messenger assigns to you, and deny yourselves that which he withholds from you. And fear Allah; for Allah is strict in Punishment.”

[Chapter Al-Hashr: Verse 7]

2. Rasulullah s.a.w. said which means,

“I leave for you two items (heritage), you will not be astray as long as you still hold on to them, that is, the Book of Allah and the Traditions of His Messenger.”

The Meaning Of The Holy Quran

The Holy Quran is the words of Allah s.w.t., which are miracles that have been revealed to His Messenger Prophet Muhammad s.a.w., which are written in book form, which are reliably transmitted to all mankind with the pronunciations and meanings in the Arabic language and its recitations are made as acts of devotion to Allah s.w.t. (‘Ibadah’).

Synopsis

The important matters that can be taken in the above mentioned meaning of the Holy Quran are:

1. The Holy Quran is the words of Allah s.w.t. to His Messenger Muhammad s.a.w. only. The original genuine texts of Torah, Zabur, Bible and others are not the Holy Quran. Indeed, all of them are the words of Allah s.w.t.

2. The Holy Quran is the words of Allah s.w.t. that has been compiled into a book form in the Arabic language. Any form of interpretation and translation in any language is not the Holy Quran.

3. The Holy Quran is made as an act of devotion to Allah s.w.t. (‘Ibadah’) when recited. Collections of ‘Hadith Nabawi’ and ‘Hadith Qudsi’ are not the Holy Quran.

4. The Holy Quran is a miracle that cannot be fabricated or challenged by any power from the past, present or future.

State of Rasulullah s.a.w. When Receiving Revelations

There are a number of states Rasulullah s.a.w. received revelations:

1. The Angel delivered the revelations directly into his heart. In this state, Rasulullah s.a.w. did not see anything. He only felt and knew that the revelations were already in his heart.

2. The Angel showed itself in the form of a man and recited the revelations to Rasulullah s.a.w. until he knew, understood and memorized them.

3. The Angel showed itself in its original form in front of Rasulullah s.a.w.

4. The revelations were delivered like the sound of chimes. This state is the hardest felt by Rasulullah s.a.w. until his eyebrows emitted sweats like pearl drops, even though in the height of the cold season. Sometimes, he felt like having a severe fever. And sometimes the camel that he rode on had to stop and sit because it also felt the heavy weight of the revelations.

Stages and Methods The Holy Quran Was Revealed

There are 3 stages the Holy Quran was revealed:

1. First Stage

From Allah s.w.t. to ‘Lauhil Mahfudz’. In this stage, the Holy Quran was revealed in its entirety with all verses or chapters.

2. Second Stage

From ‘Lauhil Mahfudz’ to ‘Baitul ‘Izzah’. In this stage, the Holy Quran was also revealed in its entirety with all verses or chapters.

3. Third Stage

From ‘Baitul ‘Izzah’ to Rasulullah s.a.w. starting 17th Ramadhan 610 AD when he was in the Hira’ cave in Mecca.

In this last stage, the Holy Quran was revealed bit by bit (step by step) for about 22 years 2 months and 22 days. Among the wisdom it was revealed in steps were:

3.1 To be easily understood and implemented by the people at that time,

3.2 To suit the incidents that had occurred and

3.3 To be steadfast in Rasulullah s.a.w.’s heart.

Classification of the Verses of the Holy Quran

There are two groups of the verses or chapters of the Holy Quran:

1. ‘Makkiyah’ : Verses that were revealed before Rasulullah s.a.w. migrated to Medina

2. ‘Madaniyah’ : Verses that were revealed after Rasulullah s.a.w. had migrated to Medina

Differences Between the ‘Makkiyah’ and ‘Madaniyah’ Verses

Among the differences are as follows:

1. Generally, the ‘Makkiyah’ verses are short and normally the ‘Madaniyah’ verses are long.

2. Generally, the ‘Makkiyah’ verses are about ‘Aqidah’ (faith), morality, stories of previous nations, warning of sins and offer of rewards.

3. The phrasal content of the ‘Makkiyah’ verses sometimes contain “Ya Aiyuhan Nas” and sometimes contain “Ya Bani Adam”. Whereas, the phrasal content of the ‘Madaniyah’ verses contain “Ya Aiyuhal Lazina Aamanu” and not “Ya Aiyuhan Nas” except in seven verses only, that is:

3.1 Two verses in Chapter Al-Baqarah Verses 21 and 168
3.2 Four verses in Chapter An-Nisaa’ Verses 1, 133, 170 and 174
3.3 One verse in Chapter Al-Hujuraat Verse 13.

4. Every chapter that has ‘Sajadah’ (Prostrate) is ‘Makkiyah’ except in Chapter Al-Hajj.

5. Every chapter that mentions “Kalla” is ‘Makkiyah’.

Writing and Compilation of the Holy Quran

During the life of Rasulullah s.a.w., the Holy Quran was not compiled into a book form that we see today. Even then, it was preserved by the following ways:

1. Memorization of the ‘Huffadz’ (Memorizers)

2. Notes by writers on rocks, animal skins, bones and date tree branches. Among the famous writers of the revelations were:

2.1 ‘Ali Bin Abi Talib r.a.
2.2 Uthman Bin ‘Affan r.a.
2.3 Ubai Bin Ka’ab r.a.
2.4 Zaid Bin Tsabit r.a. and
2.5 Mu’awiyah r.a.

3. Memorization of Rasulullah s.a.w. himself

Alongside that, Rasulullah s.a.w. always recited the Holy Quran in the daily prayers (‘Solah’) or in front of His Companions r.a. Instead, Rasulullah s.a.w. recited the Holy Quran in front of Angel Gabriel once a year except twice in the year of his demise.

First Stage Compilation

The first stage compilation occurred in the era of Caliph Abu Bakar r.a.’s rule as a result of the suggestion of Umar Al-Khattab r.a. This is because many ‘Huffadz’ were martyred in the ‘Yamamah’ war. According to narration, not less than 70 ‘Huffadz’ died in this war.

The person who was tasked to compile the Holy Quran was Zaid Bin Tsabit r.a. After the compilation was completed, it was tied with strings and handed over to Caliph Abu Bakar r.a. for his safe keeping. This first Holy Quran in book form was safeguarded by Caliph Abu Bakar r.a. until his demise. Then it was transferred to the safeguard of Caliph Umar Al-Khattab r.a. After his demise, it was transferred to the hands of his Princess Hafsah r.a. who was one of Rasulullah s.a.w.’s widows r.a.

Second Stage Compilation

During the era of Caliph Uthman Bin ‘Affan r.a.’s rule, a disagreement had happened regarding the reciting of the Holy Quran between the people of ‘Sham’ (Syria) and ‘Iraq. The first person to take note of this issue was Huzaifah Bin Al-Yaman r.a. He had suggested that the original Holy Quran in the safeguard of Hafsah r.a. was borrowed and several copies made out of it and then sent to all the capital cities of the Islamic empire at that time. Then, Caliph Uthman r.a. instructed the implementation to :

1. Zaid Bin Tsabit r.a., as the leader
2. ‘Abdullah Bin Az-Zubair r.a.
3. Sa’id Bin Al-Ash r.a. and
4. ‘Abdul Rahman Bin Harits r.a.

This compilation took about 6 years to complete, that is, between 24 – 30 H (650 – 655 AD). After completing the copying and compiling, then 4 copies were sent to Mecca, Syria, Basra and Kufa. While one copy was handed to Caliph Uthman r.a. as safeguard and reference. This copy was known as the ‘Mushaful Imam’. From this date onwards, all personal notes were burnt to avoid confusion among the Muslim Ummah.

This ‘Mushaful Imam’ was fully safeguarded by Caliph Uthman Bin ‘Affan r.a. until it never departed from him. When he was killed, his blood flowed and wetted the verse that he was reciting at that time:

“Fasayakfika humullahu……….”

[Chapter Al-Baqarah: Verse 138]

Safeguard of the Holy Quran

Although the Holy Quran was compiled in this way, it is still authentic and genuine. Any effort of fabrication towards it was still known to the Muslims. This is because:

1. The Holy Quran is a miracle that cannot be fabricated, cannot be changed and cannot be challenged.

2. The Holy Quran is under the safeguard of its Owner, that is, Allah s.w.t. He says in the Holy Quran which means:

“We have, without doubt, sent down the Message; and We will assuredly guard it (from corruption).”

[Chapter Al-Hijr: Verse 9]

3. The Holy Quran is safeguarded by the many ‘Huffadz’ all over the World.

Contents of the Holy Quran

The Holy Quran is a source of guidance for the whole of mankind in all aspects of life and in all their types of needs, whether it is for this world only or for the provisions for the Hereafter. Because of this, the Holy Quran contains all types of learning and education, all types of knowledge and anything else more.

All authors and intellectuals who are honest in their respective knowledge (except those who act as if they are knowledgeable or half knowledgeable who are arrogant) admit the completeness of the Holy Quran alongside it being the source of knowledge.

As an example, the Holy Quran and history, not only narrates past incidents but also clarifies incidents that will happen and are happening from era to era.

As an example about the knowledge that is really sought by mankind now, let us see the general principles as follows:

1. Regarding Psychology

Among the verses in the Holy Quran which means,

“By the Soul, and the proportion and order given to it; And its enlightenment as to its wrong and its right; - Truly he succeeds that purifies it, And he fails that corrupts it!”

[Chapter Ash-Shams: Verses 7-10]

2. Regarding Geology and Geography

“And the earth- We have spread it out, and set thereon mountains standing firm, and produced therein every kind of beautiful growth (in pairs) - To be observed and commemorated by every devotee turning (to Allah).”

[Chapter Qaaf: Verses 7-8]

“Between them and the Cities on which We had poured our blessings, We had placed Cities in prominent positions, and between them Wehad appointed stages of journey in due proportion: "Travel therein, secure, by night and by day."”

[Chapter Saba’: Verse 18]

3. Regarding Zoology

“And verily in cattle (too) will ye find an instructive sign. From what is within their bodies between excretions and blood, We produce, for your drink, milk, pure and agreeable to those who drink it.”

[Chapter An-Nahl: Verse 66]

4. Regarding Agriculture

“And in the earth are tracts (diverse though) neighboring, and gardens of vines and fields sown with corn, and palm trees - growing out of single roots or otherwise: watered with the same water, yet some of them We make more excellent than others to eat. Behold, verily in these things there are signs for those who understand!”

[Chapter Ar-Ra’d: Verse 4]

5. Regarding Astronomy

“And the sun runs his course for a period determined for him: that is the decree of (Him), the Exalted in Might, the All-Knowing. And the Moon, - We have measured for her mansions (to traverse) till she returns like the old (and withered) lower part of a date-stalk. It is not permitted to the Sun to catch up the Moon, nor can the Night outstrip the Day: Each (just) swims along in (its own) orbit (according to Law).”

[Chapter Yaa Sin: Verse 38-40]

“It is He Who made the sun to be a shining glory and the moon to be a light (of beauty), and measured out stages for her; that ye might know the number of years and the count (of time). No wise did Allah create this but in truth and righteousness. (Thus) doth He explain His Signs in detail, for those who understand.”

[Chapter Yunus: Verse 5]

The Field of Laws in the Holy Quran

From the viewpoint of jurisprudence, the Holy Quran contains 3 most important groups of laws, that is:

1. First Group

The Laws of ‘Aqidah’ (Faith)

2. Second Group

The Laws of Morality and

3. Third Group

The Laws of ‘Amaliyah’ (Practices). This group can be sub-divided into two,

3.1 ‘Ibadah Khassoh’ (Specific Rituals) and

3.2 ‘Mu’amalat ‘Ammah’ (General Practices). Amongst them are,

3.2.1 Family Law
3.2.2 Property and Economic Law
3.2.3 State and Administrative Law
3.2.4 Political and International Law
3.2.5 Litigation and Judicature Law
3.2.6 Criminal Law and
3.2.7 Other Laws

Types of ‘Lafadz’ (Pronunciation) and ‘Nas’ (Text) in the Holy Quran

The pronunciation and text of the Holy Quran can be divided into a few types based on certain viewpoints. We will look at two viewpoints only, that is:

1. From the viewpoint of the meaning of the content and
2. From the viewpoint of the strength of the law

From the Viewpoint of the Meaning of the Content

From this viewpoint, the pronunciation of the Holy Quran can be sub-divided into two:

1. General Pronunciation

The pronunciation that indicates on something that encompasses the whole of its unlimited content. This type is further divided into three,

1.1 Generality that really meant

1.2 Generality that needs specificity and

1.3 Generality that has been specified

2. Specific Pronunciation

The pronunciation that indicates on one or more things but it is limited. This type is further divided into four,

2.1 ‘Mutlaq’ - that indicates on a specific thing without the limitation of the
pronunciation

2.2 ‘Muqaiyad’ - that indicates on a specific thing with the limitation of the
pronunciation

2.3 ‘Amar’ - instruction to do something specific

2.4 ‘Nahy’ - prohibition to do something specific

From the Viewpoint of the Strength of the Law

From this viewpoint, the text of the Holy Quran can be sub-divided into two:

1. ‘Qat’iy’ - Text that indicates on a specific meaning that is understood and there is no
possibility at all of indicating another meaning

2. ‘Dzanniy’ - Text that indicates on a specific meaning that is understood but there is a
possibility that it can also indicate another meaning

The Meaning of ‘As-Sunnatun Nabawiyah’ (Prophetic Traditions)

‘As-Sunnatun Nabawiyah’ is “the every word, action and admission that comes from Rasulullah s.a.w.”

The Classification of ‘As-Sunnah’

There are three classes of ‘As-Sunnatun Nabawiyah’:

1. ‘Sunnah Qauliyah’ or ‘Hadith’ (Word)
2. ‘Sunnah Fi’liyah’ (Action) and
3. ‘Sunnah Taqririyah’ (Admission)

Types of ‘Sunnah Qauliyah’

There are 3 types of ‘Sunnah Qauliyah’ from the aspect of the ‘Sanad’ (chain of narrators):

1. ‘Mutawatir’ - Narrated from Rasulullah s.a.w. by a large group who are not doubtful in their truthfulness, sincerity and their moral character. Then, narrated from them by another large group who are of the same condition as the first group. And then, narrated from the second group by another large group who are also of the same condition as the previous group.

2. ‘Mashhur’ - Narrated from Rasulullah s.a.w. by one or two or a small group and then narrated from one or more of them by a large group. Then, narrated further by another large group.

3. ‘Aahad’ - Narrated from Rasulullah s.a.w. by one or two or a small group and then narrated from one or two or a small group from them and then finally narrated from one or two or a small group from them.

From the ‘Sanad’ viewpoint, it is also named ‘Hadith Sahih’ (Sound), ‘Hadith Hasan’ (Good) and ‘Hadith Dha’if’ (Weak). And they are also named ‘Hadith Marfu’ (truly from Rasulullah s.a.w. himself), ‘Hadith Mauquf’ (in it contains the words or explanation on the actions of the Companions r.a.), ‘Hadith Muttasil’ (all the ‘Sanad’ are complete), ‘Hadith Maqtu’ (there was not one or more in the last generation of narrators or only explained the words or actions of the ‘Tabi’in’ (those who have met the Companions r.a.)), ‘Hadith Mursal’ (the name of one Companion r.a. who connects this ‘Hadith’ to Rasulullah s.a.w. is not present in the ‘Sanad’) and ‘Hadith Mu’adhdhal’ (there was not one or two in the last generation of narrators).

Types of ‘Sunnah Fi’liyah’

There are 2 type of ‘Sunnah Fi’liyah’:

1. Action of doing something and
2. Action of not doing something

Action of Doing Something

Action of doing something can be divided into 3:

1. Natural type as a human being

The law of this action is allowable. But, some of the methods of these actions are a source of law.

2. Special type for Rasulullah s.a.w. only

Some of the types of these actions are a source of law.

3. Determination type to enact laws

All the types of these actions are a source of law.

Action of Not Doing Something

Action of not doing something can be divided into 2:

1. Solely not doing something whether,

1.1 there was an urge to do something but Rasulullah s.a.w. did not do it or

1.2 there was no urge to do something during Rasulullah s.a.w.’s life but there was an urge after his demise

2. Did not do something because of a reason or a particular hindrance whether,

2.1 specific to Rasulullah s.a.w. only or

2.2 natural to Rasulullah s.a.w. or

2.3 due to a specific consideration

Types of ‘Sunnah Taqririyah’

There are 3 types of ‘Sunnah Taqririyah’:

1. Admission of a particular word
2. Admission of a particular action
3. Silent on a particular word or action

The Role of ‘As-Sunnatun Nabawiyah’

There are three roles of ‘As-Sunnatun Nabawiyah’:

1. Repeats or strengthens the laws in the Holy Quran.

2. Specifies from general something, binds something absolute or clarifies something collective in the Holy Quran.

3. Realizes provisions of laws regarding something that does have any specific or general text in the Holy Quran.

The Compilation ‘Hadith’ Into Book Form

During the life of Rasulullah s.a.w., he prohibited the writing of the ‘Hadith’ because he was worried that they may be confused with the Holy Quran since the verses were still in the process of revelation. Thus, what Rasulullah s.a.w. said were memorized in the head only.

After his demise, the need to compile all the ‘Hadith’ into book form became urgent because of the following:

1. The Holy Quran has been completely revealed and no more verses will be revealed again forever.

2. Rasulullah s.a.w., who was the reference, was no longer alive.

3. The ‘Hadith’ of Rasulullah s.a.w. themselves are the source of Islamic Law.

4. The fabrication of ‘Hadith’ by the bad people had occurred, especially the Jews.

Therefore, Caliph Umar Bin ‘Abdul Aziz r.a. as the leader of the Islamic Ummah has instructed his governor in Medina, i.e. Abu Bakar Muhammad Bin Umru Bin Hazam r.a. to document the ‘Hadith’ from the year 99 – 11 H (717 – 720 AD). He had written a number of books but before he could send them, the Caliph had already passed away.

Since then, arose many scholars who had compiled the ‘Hadith’ such as:

1. Ibnu Juraij r.a. in Mecca (died 772 AD)
2. Muhammad Bin Ishaq r.a. in Medina (died 773 AD)
3. Malik Bin Anas r.a. in Medina (died 801 AD)
4. Rabi’ Bin Subaih r.a. in Basra (died 782 AD)
5. Sa’id Bin Abi Urubah r.a. in Basra (died 778 AD)
6. Himad Bin Salamah r.a. in Basra (died 798 AD)
7. Sufyan Ats-Tsauri r.a. in Kufa (718 – 783 AD)
8. Abu Umru ‘Abdur Rahman Bin Umru Ash-Shami r.a. also known as Imam Al-Auzaa’i in Syria (710 – 779 AD)
9. Qaasim Abi Bakr r.a. (died 742 AD)
10. Muhammad Bin Muslim Az-Zuhri r.a. (died in 746 AD)

In the early stages of the compilations of the ‘Hadith’, there were still a mixture of the ‘Hadith’ with the decrees of the Companions r.a. So, there arose scholars who wrote the ‘Hadith’ based on the ‘Masaanid’ (supported). They were:

1. ‘Abdullah Bin Musa Al-Abbasi r.a. in Kufa
2. Musaddad Bin Musarhad in Basra r.a.
3. Naim Bin Hamad Al-Khuzaa’i r.a. in Eqypt and
4. Ahmad Bin Hanbal r.a.

The compilation of the ‘Hadith’ based on the ‘Masaanid’ was to put each individual ‘Hadith’ narrated by each Companion r.a. separately without classifying it into any specific group.

Books of ‘Hadith Sahih’

Among the books of ‘Hadith’ that were written, there are 6 of them that are well known among the Islamic scholars. They are:

1. Sahih Bukhari

Written by Abu ‘Abdillah Muhammad Bin Ismail Al-Bukhari r.a. (Imam Bukhari) - died 878 AD

2. Sahih Muslim

Written by Muslim Bin Al-Hajjaj Al-Qushairi An-Nisaburi r.a. (Imam Muslim) – died 883 AD

3. Sunan Abu Daud

Written by Abu Daud Sulaiman Bin Al-Ash’ats As-Sajastani r.a. – died 897 AD

4. Sunan At-Tirmizi

Written by Abu Isa Muhammad Bin Isa As-Salami At-Tirmizi r.a. – died 901 AD

5. Sunan Ibnu Majah

Written by Abu ‘Abdillah Muhammad Bin Yazid Al-Qazawaini (Ibnu Majah) – died 895 AD

6. Sunan An-Nasaai

Written by Abu ‘Abdir Rahman Ahmad Bin Shu’aib An-Nasaai r.a. – died 925 AD

Apart from them mentioned above, there were also many more famous Scholars of ‘Hadith’ who amongst them we often heard were:

1. Ibnu Hibban whose full name is Muhammad Bin Hibban Al-Basti r.a.
2. Dar Qatni whose name is Abul Hasan ‘Ali Bin Umar r.a. and
3. Al-Hakim who is Muhammad Bin ‘Abdillah Na’im Ad-Dhabi An-Nisaburi r.a.

‘Hadith Qudsi’

‘Hadith Qudsi’ is a ‘Hadith’ that was narrated by Rasulullah s.a.w. about something from Allah s.w.t. It was inspired to Rasulullah s.a.w. during the time whether he was awake or asleep in the form of the meaning only. The text of this ‘Hadith’ is composed by Rasulullah s.a.w. himself and it is not a miracle.

This ‘Hadith Qudsi’ is about the feelings of human beings or the encouragement to be of high morality, attribute oneself with esteemed character, yearns for the blessings of Allah s.w.t. and afraid of His severe punishment.

Interpreted Sources

Among the interpreted sources accepted by the ‘Jumhur ‘Ulama’ (majority of the Islamic scholars) which are close to their total acceptance are:

1. ‘Ijma’ and
2. ‘Qiyas’

Meaning of ‘Ijma’

‘Ijma’ is the agreement among the ‘Mujtahid’ of Prophet Muhammad s.a.w.’s Ummah in a particular matter in a particular time after the demise of His Highness s.a.w. regarding a particular Islamic law.

Proof For This Source

Among the proofs for this source are:

1. Allah s.w.t. says in the Holy Quran which means,

This verse shows that if there is a difference in opinions, then refer it to the Holy Quran and ‘As-Sunnah’. But, if there is no difference of opinions, then it means agreement or also called ‘Ijma’.

2. The Prophet Muhammad s.a.w. said which means:

“My Ummah will not be in agreement in error.”

And he also said which means:

“My Ummah will not be in agreement in misguidance.”

Definition of ‘Ijma’

From the meaning of ‘Ijma’ above, we can understand that:

1. ‘Ijma’ must be the agreement of all the ‘Mujtahid’ at that time. Majority agreement only is not ‘Ijma’ but the opinion of the ‘Jumhur’.

2. The agreement must be among the ‘Mujtahid’ only.

3. Prophet Muhammad s.a.w.’s Ummah is defined as believers and ‘Mukallaf’ only.

4. The agreement of all the ‘Mujtahid’ must be after the demise of Rasulullah s.a.w.

5. The agreement is meant only concerning Islamic laws, not in humanitarian laws or logic.

Types of ‘Ijma’

There are 2 types of ‘Ijma’:

1. ‘Ijma Nutqi’ or ‘Ijma Sharih’

An agreement among all ‘Mujtahid’ in the form of clear words and/or actions.

2. ‘Ijma Sukuuti’

An agreement among some of the ‘Mujtahid’ only but the other ‘Mujtahid’ were not against the agreement after making an in-depth study.

Meaning of ‘Qiyas’

‘Qiyas’ (Analogical Deduction) is applying the law regarding a particular thing to another particular thing because they have the same ‘Illah’ (legal reason).

Proof For This Source

Among the proofs for this source are:

1. Allah s.w.t. says in the Holy Quran which means,

“…take warning, then, O ye with eyes (to see)!”

[Chapter Al-Hashr: Verse 2]

2. The ‘Sunnah’ of Rasulullah s.a.w. when he ‘Qiyas’ the debt to Allah s.w.t. as the debt to human beings.

The Principles of ‘Qiyas’

‘Qiyas’ must meet the following 4 principles:

1. A particular thing (original)
2. Law of a particular thing
3. Another particular thing
4. ‘Illah’ (Legal Reason)

Classification of ‘Qiyas’

There are 2 classes of ‘Qiyas’:

1. ‘Qiyas Jali’ (Clear)
2. ‘Qiyas Khafi’ (Not clear)

Types of ‘Qiyas’

There are 3 types of ‘Qiyas’:

1. ‘Qiyas Musaawi’ (Balanced)
2. ‘Qiyas Adna’ (Low)
3. ‘Qiyas Aulaa’ (High)

‘Khilaf’ or ‘Ikhtilaf’

‘Khilaf’ or ‘Ikhtilaf’ of the Islamic scholars means it is the differences in opinions among the ‘Muktabar’ (respected) Islamic scholars. The differences in opinions here means the differences in opinions on ‘Furu’ (Branch) matters only and not in the ‘Usul’ (Principle) matters like the ‘Aqidah’ because the differences in opinions in ‘Aqidah’ involves ‘Iman’ (Believe) and ‘Kufur’ (Disbelieve).

Among the reasons of the differences in opinions among the Islamic scholars are:

1. Difference in the aspect of reading a portion of the texts of the Holy Quran

2. Difference in the aspect of accepting and evaluating the ‘Hadith’

3. Difference in the aspect of understanding and interpreting texts

4. ‘Ishtirak Lafdzi’ (Equality in pronunciation)

5. Physical contradictions among the proofs

6. No specific text regarding a particular matter and

7. Difference in the methodologies of ‘Usul’

‘Ijtihad’

With regards to the ‘Khilaf’ problem, arises the problem of ‘Ijtihad’ because ‘Khilaf’ is the result of ‘Ijtihad’.

‘Ijtihad’ means the difficult and painstaking effort undertaken to perforce the best particular ability to define the ‘Syariah’ law from its particular sources.

‘Ijtihad’ is the one that gave birth to the various schools of thoughts from one another. This school of thought is known as the ‘Mazhab’. Even though like that, not all ‘Mujtahid’ have their own school of thought because ‘Ijtihad’ has particular conditions, methodologies and levels. In fact, it also has its types.

Proofs of ‘Ijtihad’

Among the proofs for ‘Ijtihad’ are:

1. Allah s.w.t. says in the Holy Quran which means,

“…take warning, then, O ye with eyes (to see)!”

2. The ‘Sunnah’ of Rasulullah s.a.w. in many matters.

Conditions of a ‘Mujtahid’

1. Must be a believer and a ‘Mukallaf’

2. Must know the Arabic language and related knowledge to it

3. Must know the intricacies of the Holy Quran and the ‘As-Sunnah’

4. Must know the intricacies of previous ‘Ijtihad’, if any

5. Must know the ‘Usul Fiqh’ (Principles of Islamic Jurisprudence) and

6. With the intention to ‘Taqarrub’ (be near) to Allah s.w.t.

Levels of ‘Mujtahid’

There are 4 levels of ‘Mujtahid’ and they are:

1. ‘Mujtahid Mutlaq Mustaqil’

‘Mujtahid’ who defines the Islamic law based on the original (main) sources using methodologies devised by him.

2. ‘Mujtahid Mutlaq Muntasib’

‘Mujtahid’ who defines the Islamic law based on the original (main) sources using methodologies devised by one of the ‘Mujtahid Mutlaq Mustaqil’.

3. ‘Mujtahid Muqaiyad’

‘Mujtahid’ who defines the Islamic law based on the methodologies and texts of his Imam. He is also known as ‘Mujtahid Mazhab’ or ‘Mujtahid Fatwa’ (Decree).

4. ‘Mujtahid Khas’

‘Mujtahid’ who defines the Islamic law in specific cases only based on the methodologies that had already been devised.

Typed of ‘Ijtihad’

There are 2 types of ‘Ijtihad’:

1. ‘Ijtihad Fardi’

An ‘Ijtihad’ that does not arise an agreement in opinion among the ‘Mujtahid’ in a particular matter.

2. ‘Ijtihad Jamai’

An ‘Ijtihad’ that does arise an agreement in opinion among the ‘Mujtahid’ in a particular matter.

School of Thought (‘Mazhab’)

The ‘Ijtihad’ that had happened after the demise of Rasulullah s.a.w. had gave birth to the various schools of thought which in turn gave birth to the ‘Mazhab’ in the respective schools of thought.

For an easy understanding to evaluate the various Islamic ‘Mazhab’ and non-Islamic ‘Mazhab’, let them be divided into schools of thought based on the root cause of the issue:

1. ‘Khilafah’ (Political) issue
2. ‘Aqidah’ (Faith) issue

‘Khilafah’ Issue

As a result of the differences in the ‘Khilafah’ issue, arose the following schools of thought:

1. ‘Shiah’

In it exists the different ‘Mazhab’ like:

1.1 ‘Mazhab Sabaiyah’
1.2 ‘Mazhab Ghurabiyah’
1.3 ‘Mazhab Kisaniyah’
1.4 ‘Mazhab Zaidiyah’
1.5 ‘Mazhab Imamiyah Itsna ‘Ashariyah’
1.6 ‘Mazhab Imamiyah Isma’iliyah’ (‘Batiniyah’)
1.7 ‘Mazhab Hakimiyah’
1.8 ‘Mazhab Daruziyah’
1.9 ‘Mazhab Nasiriyah’

2. ‘Khawarij’

In it exists the different ‘Mazhab’ like:

2.1 ‘Azariqah’
2.2 ‘Najdat’
2.3 ‘Sofariyah’
2.4 ‘Ajaridah’
2.5 ‘Abadhiyah’
2.6 ‘Maimuniyah’

3. ‘Jumhur’

This school of thought is also known as ‘Ahlus Sunnah Wal Jama’ah’. In this school of thought, there are 2 groups of Islamic scholars:

3.1 ‘Ahlul Hadith’ Group (‘Hijaziyun’) and
3.2 ‘Ahlur Rakyi’ Group (‘Iraqiyun’)

‘Aqidah’ Issue

As a result of the differences in the ‘Aqidah’ issue, arose the following schools of thought:

1. ‘Jabariyah’
2. ‘Qadariyah’
3. ‘Marjiah’
4. ‘Mu’tazilah’
5. ‘Asha’irah’
6. ‘Maturidiyah’
7. ‘Salafiyah’
8. ‘Wahabiyah’
9. ‘Bahaiyah’
10. ‘Qadyaniyah’

The various ‘Mazhab’ that were the result of the differences in the ‘Khilafah’ and ‘Aqidah’ issues above have some of them out of Islam. The various ‘Mazhab’ that are out of Islam are not Islamic ‘Mazhab’ although these ‘Mazhab’ appear in the midst of the Islamic Ummah and proclaim that they are Islamic but in reality they have become ‘Kufur’ or ‘Shirk’.

The Birth of the 4 ‘Mazhab’

Like what has been said before, in the ‘Jumhur’ school of thought there are 2 groups of Islamic scholars who differ in opinions from one another. But it must be really understood that their differences are not regarding the ‘Hadith’ as the main source of law in Islam. The differences among them are regarding:

1. How far is the role of the mind when defining laws and
2. The method of using the mind when making ‘Ijtihad’

For example, the ‘Iraq’ Islamic scholars use ‘Qiyas’ when defining laws while the ‘Hijaz’ Islamic scholars use ‘Maslahat’ (interest). As a consequence of these two differences, the ‘Hijaz’ Islamic scholars do not want to use the mind until it can create “assumptions” like what is being done by the ‘Iraq’ Islamic scholars. Also, the ‘Hijaz’ Islamic scholars do not want to research the “reasons” or “wisdom” that becomes the basis of law in a particular text.

From the differences of these two groups of Islamic scholars in the ‘Jumhur’ school of thought, there arose a number of ‘Mazhab’ in it. But, not all these ‘Mazhab’ lasted until now. In fact, some have disappeared and were not known to the ordinary people. And some have lasted and are known by all levels of society. There are 4 most well-known among them and they are:

1. ‘Mazhab Hanafi’
2. ‘Mazhab Maliki’
3. ‘Mazhab Shafi’i’
4. ‘Mazhab Hanbali’

‘Mazhab Hanafi’

The Imam of ‘Mazhab Hanafi’ is Imam Abu Hanifah r.a. His full name is An-Nu’man Bin Tsabit Bin Zauthi Bin Mah r.a. He was born in Kufa, Baghdad in the year 702 AD. He is of a Persian descent. His father had the opportunity to meet the 4th Caliph ‘Ali Bin Abi Talib r.a. When Imam Abu Hanifah r.a. was born, there were still 4 Companions r.a. who were alive. They were:

1. ‘Abdullah Bin Abi Aufa r.a. (died 709 AD)
2. Sahl Bin Sa’ad r.a. (died 710 AD)
3. Anas Bin Malik r.a. (died 712 – 717 AD) and
4. Abu Ath-Thufail ‘Amir Bin Watsilah r.a. (died 722 AD)

Teachers of Imam Abu Hanifah r.a.

Among his teachers were:

1. Hammad Bin Abi Sulaiman Al-Ash’ari r.a.
2. Zaid Bin ‘Ali Zainal ‘Abidin r.a.
3. Ja’afar As-Sodiq r.a.
4. ‘Abdullah Bin Al-Hasan Bin Al-Hasan r.a.
5. Ibrahim An-Nakha’i r.a.

However, he did not learn from the Companions r.a. This may be due to that he was still at a very young age when they had already passed away.

Students of Imam Abu Hanifah r.a.

The 2 groups of his students were:

1. Students who had learned from him briefly only and

2. Students who had learned from him on a permanent basis. According to narration, students in this group were,

2.1 28 people who qualified as ‘Qadhi’ (not like the ‘Qadhi’ in Malaysia or any country
nowadays)

2.2 6 people who qualified as ‘Mufti’ (in the widest of meaning)

2.3 2 people who were more qualified as ‘Qadhi’ and ‘Mufti’, that is, Abu Yusof Ya’qub Bin
Ibrahim Bin Habib Al-Ansori r.a. and Zufar Bin Al-Huzail Bin Qais Al-Kufi r.a.

Sources of Law of ‘Mazhab Hanafi’

In this ‘Mazhab’, there are 7 sources:

1. Holy Quran
2. ‘As-Sunnatun Nabawiyyah’
3. ‘Atsar’ of the Companions r.a.
4. ‘Al-Qiyas’
5. ‘Al-Istihsan’ (Legal discretion)
6. ‘Al-Ijma’ and
7. ‘Al-‘Urf’ (Society custom)

The Books of ‘Mazhab Hanafi’

There are 3 groups of reference books in this ‘Mazhab’:

1. Books of ‘Dzahirur Riwayah’
2. Books of ‘An-Nawadir’ and
3. Books of ‘Al-Waqi’at’

The first group of books is the most important reference in ‘Mazhab Hanafi’ while the last group of books is the ‘Fatwa’ (Decree) of the ‘Mujtahid’ bounded by this ‘Mazhab’.

Demise of Imam Abu Hanifah r.a.

Imam Abu Hanifah r.a. passed away in 772 AD. The person who had cleansed his body before the funeral was Al-Hasan Bin ‘Imarah r.a. and was prayed by more than 50,000 people including Abu Ja’afar Al-Mansur r.a. Then, he was put to rest at the Al-Khizran cemetery in the east of Baghdad.

‘Mazhab Maliki’

The Imam of this ‘Mazhab’ is Malik Bin Anas Bin Malik Bin Abi ‘Amir Bin ‘Amru r.a. He was born in the north of the city of Medina in the year 715 AD. He was in the womb of his mother Al-Ghaliyah Binti Sharik Bin ‘Abdur Rahman r.a. for more than 2 years.

Teachers of Imam Malik r.a.

There is a narration that Imam Malik r.a. had about 900 teachers. That is, 300 teachers from among the ‘Tabi’in’ (Followers) and 600 teachers from among the ‘Tabi’it Tabi’in’ (Followers of the Followers). Among them were:

1. ‘Abdur Rahman Bin Hurmuz Al-A’raj r.a.
2. Rabi’ah Bin Abi ‘Abdir Rahman Farukh r.a.
3. Ja’afar Bin Muhammad Al-Baqir r.a.
4. Muhammad Bin Muslim Az-Zuhri r.a.
5. ‘Abdur Rahman Bin Zakwan r.a.

Sources of Law of ‘Mazhab Maliki’

In this ‘Mazhab’, there are 6 sources:

1. Holy Quran
2. ‘As-Sunnatun Nabawiyyah’ (including the ‘Fatwa’ of the Companions r.a. and the customs of the Medina people)
3. ‘Al-Qiyas’
4. ‘Al-Maslahah’ (Interest or source of benefit)
5. ‘Al-Zarai’ (whatever that leads to good or bad) and
6. ‘Al-‘Urf’ (Society custom) and ‘Al-‘Adat’ (Tradition)

Demise of Imam Malik r.a.

He died in Medina on 14th Rabi’ul Awwal 179 H (801 AD) after being sick for 22 days. He was laid to rest at the Al-Baqi’ cemetery.

‘Mazhab Shafi’i’

The Imam of this ‘Mazhab’ is Abu ‘Abdillah Muhammad Bin Idris Bin Al-‘Abbas Bin ‘Utsman Bin Shafi’i Bin As-Saib Bin ‘Ubid Bin ‘Abdi Yazid Bin Hashim Bin Al-Muttalib Bin ‘Abdi Manaf r.a. He is related to Rasulullah s.a.w. by way of his descents at his great grandfather ‘Abdi Manaf. He was born in Ghazzah in the year 772 AD and then moved to ‘Asqalan and lived among the clans in Yemen. After reaching 2 years of age, he moved to Mecca with his mother Fatimah Binti ‘Abdullah r.a. When he was 13 years old, he furthered his studies in Medina. From there he went to study in Yemen, Baghdad (817 AD), Mecca (819 AD) and Baghdad (820 AD). Then, he moved to Egypt in the year 821 AD.

Teachers of Imam Shafi’i r.a.

Among his teachers were:

1. Muslim Bin Khalid Az-Zanji r.a. (Mecca)
2. Sufyan Bin ‘Uyainah r.a. (Mecca)
3. Imam Malik r.a. (Medina)
4. Ibrahim Bin Sa’ad Al-Ansori r.a. (Medina)
5. Matraf Bin Yazin r.a. (Yemen)
6. Muhammad Bin Al-Hasan r.a. (Baghdad)
7. Waki’ Bin Al-Jarrah Al-Kufi r.a. (Baghdad)

Sources of Law of ‘Mazhab Shafi’i’

In this ‘Mazhab’, there are 5 sources:

1. Holy Quran and ‘As-Sunnatun Nabawiyyah’
2. ‘Al-Ijma’
3. ‘Al-Atsar’ of the Companions r.a. with no ‘Khilaf’
4. ‘Ikhtilaf’ of the Companions r.a.
5. ‘Al-Qiyas’

Periods of ‘Mazhab Shafi’i’

There were 2 periods of ‘Mazhab Shafi’i’, that is:

1. When he was in ‘Iraq and known as ‘Qaul Qadim’. The period is before the year 821 AD.
2. When he was in Egypt and known as ‘Qaul Jadid’. The period is the year 821 AD until now.

Demise of Imam Shafi’i r.a.

He died on 29th Rajab 204 H (826 AD), that is, Thursday night after Maghrib. He was laid to rest on Friday after ‘Asar in Egypt.

‘Mazhab Hanbali’

The Imam of this ‘Mazhab’ is Abu ‘Abdullah Ahmad Bin Muhammad Bin Hanbal Bin Hilal Bin Asad Bin Idris Bin ‘Abdillah Bin Hayyan Bin ‘Abdillah Bin Anas Bin ‘Auf Bin Qasith bin Mazin Bin Shaiban r.a. He was born in Baghdad in the month of Rabi’ul Awwal 164 H (786 AD). There is also a narration that he was born in Maru, Persia. His mother was Sofiyah Binti Maimunah Binti ‘Abdil Malik Ash-Shaibani r.a.

He was once tied up with chains and dragged from the city of Baghdad to Tartus and was imprisoned there for 28 months. In this prison, he was beaten up by the staff of Caliph Al-Makmun for not saying what is against his own understanding.

Because of poverty, at one time he used to work as a tailor, writer and laborer. During his life, Imam Ahmad r.a. managed to perform the ‘Haj’ 5 times, 3 of them by just walking and at one time he got lost.

Teachers of Imam Ahmad r.a.

Among his teachers were:

1. Abu Yusof Ya’qub Bin Ibrahim r.a.
2. Hushaim Bin Bashir Bin Abi Hazim Al-Wasithi r.a.
3. ‘Umair Bin ‘Abdillah Bin Khalid r.a.
4. Imam As-Shafi’i r.a.
5. Sufyan Bin ‘Uyainah r.a.

His Lectures

There were 2 types of courses that he had offered, that is:

1. General courses that he had delivered after ‘Asar prayers in the Jami’ Mosque in Baghdad and
2. Specific courses that he had delivered at his own home

Among his students were:

1. Yahya Bin Adam r.a.
2. Imam Bukhari r.a.
3. Imam Muslim r.a.
4. Imam Abu Daud r.a.

According to history, it was said that the students that had attended his general courses numbered about 5,000 people at any one time.

Sources of Law of ‘Mazhab Hanbali’

In this ‘Mazhab’, there are 7 sources:

1. Holy Quran
2. ‘As-Sunnatun Nabawiyyah’
3. ‘Al-Atsar’ of the Companions r.a.
4. ‘Al-Qiyas’
5. ‘Al-Ijma’
6. ‘Al-Masoleh Al-Mursalah’ (Public interest)
7. ‘Az-Zarai’

Demise of Imam Ahmad r.a.

He died during ‘Dhuha’ time on Friday 12th Rabi’ul Awwal 241 H (863 AD). The person who had cleansed his body before the funeral was Abu Bakar Ahmad Bin Muhammad Bin Al-Hajjaj Al-Maruzi r.a. and he was laid to rest in Baghdad.

‘Talfiq’ Issue

There are 2 types of ‘Talfiq’:

1. ‘Talfiq Ijtihad’

The action of a ‘Mujtahid’ who takes a portion of the opinions of a number of ‘Mujtahid’ and mixes them with a portion of the opinions of another number of ‘Mujtahid’

2. ‘Talfiq Taqlid’

The action of choosing a portion of laws in a certain number of ‘Mazhab’ and leaves behind the other portions

‘Taqlid’ Issue

‘Taqlid’ is following another person in a particular law as proof. ‘Taqlid’ can happen in 3 forms:

1. An ordinary people following a religious scholar
2. An ordinary people following another ordinary people and
3. A religious scholar following another religious scholar

‘Bid’ah’ Issue

‘Bid’ah’ is a particular innovation that has no similarity before it. It is divided into 2:

1. ‘Bid’ah Hasanah’

A particular innovation that is good and is not against the teachings of the Holy Quran and ‘As-Sunnah’. This innovation is also called ‘Khair’ (Good), ‘Huda’ (Guidance) and ‘Mahmudah’ (Praiseworthy).

2. ‘Bid’ah Saiyiah’

A particular innovation that is bad and is against the teachings of the Holy Quran and ‘As-Sunnah’. This innovation is also called ‘Syar’ (Bad), ‘Dhalal’ (Misguided) and ‘Mazmumah’ (Disgraceful).

Proofs of the Divisions of ‘Bid’ah’

Rasulullah s.a.w. had said which means:

“Whoever innovates a ‘Sunnah’ that is good, the reward is that of oneself and of the one who performs this ‘Sunnah’.”

And Rasulullah s.a.w. also said which means:

“Whoever innovates a ‘Sunnah’ that is bad, the sin is that of oneself and of the one who performs this ‘Sunnah’.”

[Hadith]

From the ‘Hadith’ of Rasulullah s.a.w. above, we can understand that the word ‘Sunnah’ here does not mean the ‘Sunnah’ of Rasulullah s.a.w. but means ‘Bid’ah’ because there is no ‘Sunnah’ of Rasulullah s.a.w. that is bad.

Our Comments:

1. As we have highlighted before, this author likes to use Islam to argue out his political point. In essence, he likes to confuse and divide the Muslims with his writings. So, we wonder whether he is a ‘Sunni’ or a ‘Shiah’. It is not that we want to divide the Muslims but one must be objective, realistic and careful in putting forward one’s opinions on the unity of the Muslim Ummah. There is no use in portraying this difference in the midst of so many problems facing the Ummah. We do not need another dividing factor to worsen the situation now.

2. Since the author is very stubborn and insists to argue along this line again, we have no choice but to clarify this matter to the readers so that confusion and ignorance will not be rampant in society.

3. Firstly, Rasulullah s.a.w. had indicated to the Muslim Ummah that he preferred Abu Bakar r.a. to succeed him. His Highness did not say it specifically but said that if he were to have a companion other than Allah s.w.t. in this World, he would want Abu Bakar r.a. to be his companion. Also, Rasulullah s.a.w. had asked Abu Bakar r.a. to lead the prayers at that time when Rasulullah s.a.w. was sick.

4. Secondly, Rasulullah s.a.w. died on his birthday i.e. on Monday 12th Rabi’ul Awwal 11 H (632 AD). One narration said he was buried the day after his death i.e. Tuesday and another said 3 days later i.e. Wednesday. Irrespective of which day he was buried, it was clear that the 1st Caliph of Islam was elected through the process of consultations among the Companions r.a. They had chosen Abu Bakar r.a.

5. Thirdly, there was no record saying that Rasulullah s.a.w. whispered into the ear of Ali Bin Abi Talib r.a. to succeed him and be the 1st Caliph of Islam. This argument would not hold water as it has been refuted as in argument no. 3 above. Our records showed that Fatimah r.a. was the one that Rasulullah s.a.w. whispered into her ears during His Highness’s last moments.

6. Fourthly, even if Rasulullah s.a.w. was buried 3 days after his death, the decision of electing Abu Bakar r.a. to be the 1st Caliph was already concluded the day after Rasulullah s.a.w.’s death. So, according to one narration, people were praying and paying their last respects to Rasulullah s.a.w. until late Wednesday, not because they were arguing and fighting on who should be the 1st Caliph.

7. Fifthly, even on his death bed, Rasulullah s.a.w. taught the importance of transparency to the Muslim Ummah. The issue of the leadership of the State is not a meager problem. As such, it has to be done properly and transparently, not based on personal views and whispers.

What have been written here were the personal views of the Hantu Laut blog author. Being a non-Muslim, we do not expect him to understand Islam correctly and comprehensively. 1. We would like to warn Nga Kor Ming not to recite the verses of the Holy Quran in the wrong pronunciation and state it from a non-existent Chapter of the Holy Quran. For this mistake, he should make a public apology. It is alright to quote the meaning or translation of the verses of the Holy Quran in a respectful manner, in whatever language, because that is no longer the Holy Quran as defined by Islam.

2. Islam does not prohibit anyone from quoting the truth in the verses of the Holy Quran in a respectful manner. Islam only prohibits the insult and denigration on the verses of the Holy Quran. If anyone regards the Holy Quran in high esteem, then Islam welcomes them. We welcome any non-Muslim to understand the truth in the verses of the Holy Quran. Who knows may be one day they will embrace Islam and become Muslims.

3. So, we must be able to differentiate between what is right and what is wrong. What is truth and what is falsehood. We do not question Nga Kor Ming’s intentions when he recited the said verses and leave them to Allah s.w.t. to determine them. If his intentions are good, Allah s.w.t. will reward him with goodness and if they are otherwise, then Allah s.w.t. will reward otherwise. This is the justice of Islam.

1. The author is using Islam again to drive through his political point. We condemn him to the bones for insulting Islam again. The author talks as if only Muslims who oppose the Rulers are true Muslims. It is not for him to judge who are true Muslims and who are not. This is the last thing any knowledgeable and wise propagator of Islam would do to promote and propagate Islam correctly.

2. Does he really know the difference between Ahlus Sunnah Wal Jama’ah and Shiah? Well, we’ll discuss that in length in our next article titled “Islamic Jurisprudence – Part 2” in the days ahead.

3. For now, it is suffice to say that the author’s biased and distorted view of the ‘Da’wah’ work done by the Great Prophets and Messengers a.s. of Allah s.w.t. was not like what Islam says. The central theme of their call to the people is ‘At-Tauhid’ i.e. the Oneness of Allah s.w.t. This call does not care whether the target audience is a Ruler or a commoner. It is the same call. Only the approaches and methodologies may vary from location, time and society.

4. The author should not instigate and blow up the differences between the Ahlus Sunnah Wal Jama’ah and the Shiah to prove his point of supporting Nizar. He is being selfish. He is acting traitorously in the sense that he is instigating the people to be traitorous to the Sultan of Perak, whether directly or indirectly. Once a traitor always a traitor. We should encourage unity among the Muslims by not bringing forth differences when facing the common enemies of Islam, like the Jews who have mercilessly attacked the Muslims in Palestine and the armies that have invaded Iraq and Afghanistan in the name of democracy. Let the people of these countries decide their own fates in their own homeland. To help them achieve this through peace talks and mediations are highly commended.

5. So, we strongly recommend that the Government seriously take action against this author so that he can no longer deceive, instigate and propagate treacherous acts, divide the society and cause confusion among the Muslims and non-Muslims alike. Charge him in court until kingdom come. Period.

Last weekend I had the pleasure of renewing my 30-year acquaintance with a really lovely guy I've always known as Bok, though his official name is Raja Zailan Putra Raja Dato' Seri Haji Azam.

A mutual friend introduced us back in 1979 or 1980. I knew at the time that Bok boasted a royal pedigree. I saw photographs in his modest house of colorful characters in courtly regalia.

One that stood out was of Bok's great-grandfather, Raja Muda Abdullah (right), who signed the 1874 Pangkor Treaty with Sir Andrew Clarke and was anointed Sultan Abdullah of Perak.

Things started to go awry soon after that when the British sent a colonial officer named James Wheeler Woodford Birch (3 April 1826 - 2 November 1875) to Perak to serve as advisor to the Sultan.

Our Comments:

1. To set the record straight once and for all, the late Sultan Alang Iskandar Shah had an admonition about Tengku Putra Ash-Sha'ari. His Highness said to Tengku Putra Ash-Sha'ari, "You have been chosen to take care of our family, so you cannot become a Sultan". So, that is what Tengku Putra Ash-Sha'ari has been been doing all this while with so much dedication. Not even once came across his mind to be a Sultan, although he is of this breed. He knows that he was entrusted with this very important and heavy responsibility on all the affected States, including Brunei. All of us in the group are like this.

2. A final warning to all and sundry, let the Royals handle their own Royal matters themselves. Do not interfere, especially the UMNO politicians.

3. We condemn Antares, the author of the MAGICK RIVER blog to the bones for his latest post in distorting the facts of Perak's history, especially on the Royals.

4. Dato' Maharaja Lela was a pious and knowledgeable man. Sultan Abdullah entrusted him to be the Qadhi at that time. He was known as Dato' Maharaja Lela 'Pancung Tak Bertanya' (Behead without asking).

5. The killing of Birch was not due to him bathing in a river naked. At that time, Birch was having a shower in his bath when he was killed. Birch was very obnoxious and repressive towards the people of Perak at that time. He wanted to control Sultan Abdullah and his subjects to the letter. So, that is why the subjects at that time revolted and assassinated Birch. Furthermore, the people of Perak wanted to free themselves from British rule. Then, the colonial masters blamed Sultan Abdullah for the uprising and exiled him. For a better account of the incidents that had happened, read here, here, here, here, here and here.

6. This was what the colonial journalist wrote about Sultan Abdullah:

"As for Raja Abdullah, who started off by receiving British recognition but ended up by being exiled to the Seychelles, Birch found him 'eminently silly and foolish' and conveyed in his reports the lowest possible estimate of the prince's moral character. But Birch obviously had an axe to grind. Sir Andrew Clarke, the freshly arrived Governor of the Straits, formed a different impression when he interviewed Abdullah. 'It may be here stated that the Raja Muda has been represented as a person of such debauched habits, and bad health, mental and bodily, as to be unfit to rule: but it was only necessary to be in his company for a few minutes to see that this was an erroneous opinion. The Raja Muda not only looked well in health, but was alert and ... more than ordinarily sharp and intelligent'. 'It is charitable to suppose', observed Swettenham, 'that early disappointment had embittered his life, for he possessed good qualities. He was undeniably intelligent, and had a wider knowledge of his country than any other man in it. He knew his own mind, was determined to obstinacy, and asked counsel of few.'"

Dr M still slams Pak Lah

KUALA LUMPUR, March 30 - The so-called rapprochement between Tun Dr Mahathir Mohamad and Datuk Seri Abdullah Ahmad Badawi could be stillborn after the former prime minister continued biting criticism against his successor.

This time, Dr Mahathir took his criticism to an international audience, using the platform of the BBC to say that "everthing went rotten" after Abdullah became prime minister.

He also lashed out at Khairy Jamaluddin and Kamal Abdullah, the son of the PM saying that both men decided on policies during the Abdullah era.
"Everything went wrong when Abdullah took over...", he said.

Despite being asked several times, if some of the problems in Umno and Malaysia was the result of mistakes which he made during 22 years as the PM, Dr Mahathir refused to acknowledged any shortcomings.

1. The main reason why UMNO and the Government is so corrupted today is because of the 22 years of Dr Mahathir Mohamad's autocratic rule. He himself is corrupted and popularly known as Mr 10%. He's trying to point a finger at Abdullah but the people know that he is trying to hide from his own mistakes. He can deceive people outside Malaysia and who are naive but he cannot deceive people like us.

2. His cohorts say that the Opposition is going around the World condemning the Government but Dr M is also doing the same thing. These are the people who are the real trouble makers.

3. Do we think that 22 years of corruption borne by Dr M can be eliminated in just 5 years during Abdullah's time? That's why we have strongly urged Abdullah to stay on as PM until 2013 to complete his reform agenda. If Abdullah steps down now from being the PM, then Dr M and his cohorts will return to the old days of autocratic rule of Dr M. And this is not good for democracy.

4. What good is material progress and development when the Government (especially from UMNO) is corrupted to the core. So, Abdullah's reform agenda to improve on the human capital is critically needed to eradicate corruption in the Government and BN.

5. Taking credit when in good times and denying accountability when in bad times is not a good statesman's trait. This trait is typical of an opportunist.

6. To us, Dr M picking Abdullah as PM was not a mistake. This is the beginning of a process to cleanse the Government and Malaysia from corruption, materialism, cronyism, tyrannism and whatever bad ism that there are in our society. In fact, Dr M himself is in a self-denial mode.

7. The so-called rapprochement between Tun Dr Mahathir Mohamad and Datuk Seri Abdullah Ahmad Badawi was just a show for UMNO to gain popularity.

TV9 Spreading Evil !!!

1. We saw on TV9 this morning in their 'Nasi Lemak Kopi O' program that host Aziz Desa has recited some Malay incantations ('jampi') and then prescribed them to his female co-host.

2. This act is considered 'shirk' in Islamic teachings. Only incantations in the form of reciting the verses of the Holy Quran and acceptable prayers ('Doa') are permissible in Islamic teachings. Other than that, the act is considered studying deviant teachings. It just needs one incantation and the satans/devils will come to associate themselves with the reciter. So, the reciter needs to get spiritual medical help to rid him of this disease and sin.

3. We strongly recommend that TV9 give a final warning to Aziz Desa to not spread deviant teachings on this live program. If he refuses, then remove him from being host for any TV9 programs in future. Or else, all those who are responsible in TV9 will shoulder the sin of spreading evil to the people.

SHAH ALAM, March 10- The Movement Opposing the Teaching of Science and Mathematics in English (GMP), which held a street demonstration on Saturday has an ally in DAP’s Teresa Kok.

Kok, who is both the Seputeh MP and Kinrara assemblyman, said that rural pupils from all races were severely handicapped by the policy.

“Imagine, these children are trying to cope with the ABC and have the added burden of learning maths and science in a language foreign to them.”

The Selangor executive council member said contrary to media statements from the government, parents of rural pupils had opposed the policy, introduced six years ago, from day one.

Our Comments:

1. We do not support the teaching of Science and Mathematics in English because:

1.1 It is difficult for the children in the rural areas to comprehend the contents of the subject matter while trying to grasp with the English language at the same time. The Government had ignored the protests of the rural folks. So, this has become a campaign issue for the GE because the Government has put a deaf ear on the rural folks and BN only thinks of the elites, cronies, rich, famous and urban dwellers.

1.2 The Malay language is suppose to be the National language as enshrined in the Constitution of Malaysia. So, the Government should treat it that way across the board. There is no two ways about it. However, other mother-tongue languages can still be learnt at the vernacular schools. There is no problem here. We do not want our children to grow up to be like that UMNO Melbourne student who speaks our National language with an English slang or intonation.

1.3 We must retain and maintain our true national identity as Malaysians. Look at all the countries around us. Do they have a 'mixed-up' ('rojak') instruction delivery system in their primary and secondary schools' curriculum? They are proud Chinese, Koreans, Japanese, etc. So, we Malaysians must honor our National language to the hilt.

1.4 We learn knowledge faster in the language that we are fluent with. This is the building block for our children. Once their building blocks are strong, then learning other languages will not be much of a problem because their intellectual capacities have expanded and they are able to cope with the brain strain in the learning process.

1.5 We share the views of many known scholars around the World that however hard we to try to gain and chase the West on Science and Technology, we will never equal or surpass them as a whole. We may be ahead in a few small achievements and that's about it. So, knowing this fact, we should not waste our time and it is better for us to concentrate or prioritize on our own culture and traditions, especially on Islam, other ethnic strengths and what we do best, without neglecting Science and Technology along the way. In these aspects, we are definitely ahead of them, especially in truth, justice, equality, morality, plurality, Islamic economics and the human capital, to name a few.

2. So, we strongly recommend the Education Minister to revert teaching Science and Mathematics in the National language starting the school term for the year 2010 in both the primary and secondary schools.

3. The Education Minister can review this policy again when we have already achieved the developed nation status in the year 2020, inshaAllah.

1. We commend Pak Lah on his deep and soul-searching speech in the general assembly. All UMNO and ex-UMNO members should take serious heed on what he had said. However, we were very disgusted when we saw an UMNO Melbourne student rudely criticizing Pak Lah on TV1. This student spoke in the Malay language with an English slang. What a shame. That shows he has been materialized and westernized. We do not want this kind of Malay leadership for our future generations.

2. Today, UMNO and her members have sealed their fates. We have 'Amin' the prayer ('Doa') made by Pak Lah on those people who have conspired to bring him down as UMNO President. Those people will have to live with this curse until they repent. Pak Lah is a nice guy and of high morality. He does not mind giving up the Presidency to this greedy lot. We shall see what the future have in store for these conspirators. Personally, we will not let them off scot free.

3. Consequently, there will be factions in UMNO and later, turmoil in the country. We saw their strategy in giving Khairy the Youth leadership so that they can blame him if UMNO cannot win the hearts of the young voters in the 13th GE which will cause the BN to lose the Federal Government, inshaAllah.

4. The new UMNO leadership line-up is not totally clean. They should have dropped Muhyiddin Yassin, Mohd Shafie Apdal, Musa Aman, Jamaluddin Jarjis, Mahadzir Khalid, Zulhasnan Rafique, Idris Jusoh, Abdul Azeez Abdul Rahim, Khairy Jamaluddin, just to name a few. So, Najib will have a very hard time in regaining the trust and support of the people to win back the 2/3 majority in the 13th GE with this team behind him. We are of the opinion that Najib can only last as PM until the 13th GE, inshaAllah.

5. So, coupled with the curse hanging above their heads and without a winning team, Najib better come out with some miraculous strategies to pull it off in the next GE. We will push very hard for the abolishment of the postal votes because BN has used them to win the last GE. We have received reports from the Armed Forces themselves. Without these postal votes, PR would have formed the Federal Government already.

The fate of UMNO has been sealed with the conclusion of this election results. All members that have made mistakes in their choices shall have to bear the consequences and live with it for the rest of their lives.

6. Lastly, we re-iterate that whoever upholds the Sovereignty of the Malay Rulers shall be blessed and shall be able to form a Government for Malaysia, be it BN or PR. If both uphold the Sovereignty of the Malay Rulers, then the more sincere of the two will prevail, inshaAllah. Period.

1. As we have mentioned before, Pekida has been tainted with deviant practices and gangsterism since its inception. We are definitely not them and not even close to their likes. We disapprove of all the wrong things that they are doing now. Our stand is very clear on ISA since we started this blog. So, whoever is not against the ISA is against us.

2. Although we have foresight on a May 13-like incident in future, we do not go around telling and instigating people about it. For the author's information, the root cause will not be Pekida. We will advise the public in due time.

3. Freedom of speech does not mean that we can say anything we like. It means that we must say the truth, enjoin good and forbid evil. Our Prophet Muhammad s.a.w. has taught us that if we have nothing good to say, then it is better to keep quite. Other than that, we cannot use the excuse of freedom of speech, as defined by the West, to blurt our hearts' desires. We must be responsible of what we say. If not, people like Geert Wilders will go off scot free.

4. To proclaim that someone's blood is 'halal' is not our job. There are many factors to consider. The most important factor is whether this someone is against Islam or not. If this someone is without a doubt against Islam and wages war against Islam and/or Muslims, then only the religious authorities can proclaim that this someone's blood is 'halal'. Not any Dick, Tom and Harry can proclaim this very sensitive and heavy sentence. So, the author should limit himself from writing such things that can stifle religious tensions. We can take such examples in Palestine, Iraq and Afghanistan for that matter.

5. So, if anything bad befall the author, do not blame others but himself. We can understand his bitterness and vengeance at heart on UMNO. We really sympathize. But, this is not the way to get back to them. Let Allah s.w.t. decides their fates. Our duty is to be steadfast and patient. Then only victory will come, inshaAllah.

Our Comments:

1. The author wrote "However, in that same breath, Malays will say they are Malays first and all else second". Not all Malays are like that and we certainly are not like that.

2. The author wrote "And this is what makes the Malays most complicating animals". Do not denigrate the Malays, the Malay Rulers are Malays and we are also definitely Malays. Do not spit into one's own face.

3. Nizar is traitorous to the Sultan of Perak. So, anyone who supports Nizar to be traitorous to the Sultan of Perak is also traitorous to the Sultan of Perak. There is no two ways about it. The author needs to seek His Highness's forgiveness.

4. The author wrote "There are not many Monarchies left in this world. Even Australia wants to dispose of its Queen. About half the Monarchs live in Malaysia, which has ten". Do not equate the Malay Rulers with the other Monarchs of the World. They are not the same. The Malay Rulers are the Heads of Islam in their respective States. This is also same for Brunei and other similar Muslim countries. As we have said many times before, they are the Vicegerents of Allah s.w.t. on this Earth, however fallible they may be.

5. We greatly appreciate the author's love and loyalty for the Malay Rulers and for his efforts to safeguard their positions since 20 years ago. However, it is improper for the author, mind you we are only talking about the author, to criticize the Malay Rulers openly. There is a better and wiser way to do that. Furthermore, although we had no choice and we were not ready 20 years ago, the author should not have attached any strings when safeguarding the Malay Rulers. We demand sincere loyalty always, as shown and proven by Hang Tuah.

6. Well, our simplified version of Hang Tuah's predicament of old is like this. The episode of Hang Tuah being sentenced to death by the Sultan of Malacca was already destined as something that the later generations would be able to learn from. It was also a test for all and sundry at that time.

Hang Tuah is a loyal and sincere follower of the Sultan of Malacca. Even at the time of losing his life, he was still loyal and sincere. He loves his Sultan more than his life. During his and his friends learning with Mahaguru Adi Putra, they were told of this coming incident already. So, Hang Jebat already knew that one day he would be traitorous. Nothing in this world could have changed his fate. That is the true foresight of the Mahaguru. It was also a test for the five of them, being pupils of the Mahaguru.

The Taming Sari Keris is no ordinary keris. It has been destined with 'Sakti' to protect the Sultan and his family. Whoever carries it will be invincible, in so far as to protect the life of the Sultan and his family. However, when Hang Jebat had it, he became traitorous to the Sultan and this had caused him to ran amok, not because of himself so much but because of the Keris. Anyone who unsheathe the Keris without permission from its rightful owner/bearer/keeper or is not the rightful person who can unsheathe it, he will definitely ran amok. This is even more so if this person is traitorous to the Sultan. Nowadays, if anyone does not believe in this fact, try and unsheathe the Keris and see for yourself.

So, it not a matter of who is(are) the hero(es) and villain(s) in this episode. It is about the genuine truth, love, loyalty and wisdom.

Today, I want to talk about these three news items from The Star. I admit I have already elaborated on these issues in great detail in the past. For all intents and purposes, I am merely repeating myself. But it appears they are still harping on these issues so I have no choice but to continue flogging what I view as a dead horse.

Our Comment:

1. In the first article above, we would like to draw the people’s attention to the confusing nature of the author about Islam, as he has done so many times before. In this article he is portraying Islam from his confused perception and perspective of Islam. To make it worst, he has quoted Ahmad Mansour who is a Quranist. This shows that the author does not care from where he takes his sources as long as it fits into his line of argument.

2. Does the author really know who is Ahmed Mansour? Read about him here. The author tells us that he is well-versed in the ‘Aqidah’ of Islam but in fact he falls short of that. To give just one simple example, if he can quote Ahmad Mansour who rejects the ‘Sunnah of Rasulullah s.a.w.’, then this affects the ‘Aqidah’. Islam says whoever does not accept the authentic ‘Sunnah of Rasulullah s.a.w.’ knowingly and willingly, then this person is no longer a Muslim. Read here to safeguard our ‘Aqidah’.

3. Does the author know that the Holy Quran is the ‘words of Allah s.w.t.’? We know and believe that Allah s.w.t. was alone before anything was created in all existence. Simple logic will tell us that the Holy Quran must be with Allah s.w.t. even before anything was created in all existence.

4. With just the above arguments, we do not have to dwell with the other points raised in the first article. With just this one point alone, we are able to discredit the author and also his source of reference. Even more so, the Ahlus Sunnah Wal Jama’ah does not accept the Quranists. The Malaysia Waves website is all mum about this.

5. In his second article, he still wants to confuse people by arguing that it is alright to accept the Quranists by spinning the truth. He quotes a number of ‘Hadith’ to prove his point. He does not know or pretend not to know that Prophet Muhammad s.a.w. forbade the writing of his Sunnah so that it would not be confused with the Holy Quran. The Prophet s.a.w. did not forbid to accept and follow his Sunnah. So, we are asking the author, are you a Quranist? Are you the supporter of the Quranists? Do you have anti-Hadith friends who influence you to write such confusing articles? Or do you like to create confusion with the notion of drawing attention to your writings? Or is it just plain ignorance about Islam? Or worst still, are you trying to show off? Do not use Islam for your own selfish needs. The author is only good in conventional politics and should stick and limit himself to it.

6. Well, if only just one yes answer to the above questions that would make this author really look bad. So, we recommend the Government to closely monitor the author’s writings, or anyone for that matter, about Islam and if they confuse the people again, charge them in the Syariah Court until kingdom come. In this way, we are able to avoid many confusions about Islam perpetrated by this kind of authors. Warning !!! Do not use ISA on these authors. We are against ISA to the bones because it is unIslamic.

Our Comment:

1. We don't need the Home Minister to answer Raja Petra's questions. A typical Muslim with a good Islamic education up until Form 5 should be able to refute Raja Petra's arguments. If they can’t, they better study harder.

2. First argument, although Allah s.w.t. has 99 names, only one name is being used in the 'Kalimah Shahadah'. So, this name is central to the Islamic faith. All other names of Allah s.w.t. describe His attributes.

3. Second argument, the Christians are claiming to use only the word "Allah". They are not claiming to use the other names of "Allah". So, as far as the other names of Allah s.w.t. are concerned, it is a non-issue.

4. Third argument, Raja Petra claims that the Bible uses the word "Allah". So, the theme of the dispute is only the word "Allah". Do you think the Christians are interested in the other names of Allah s.w.t.? No, we bet that they don’t even want to hear them. So, do not confuse the issue.

5. Fourth argument, the bad Christians want to confuse the ignorant and liberal Muslims into thinking and believing that whether they have faith in "Allah" as believed by Muslims or Christians, it does not matter as long as they believe in the same God. They will say that it is the same since in the olden days the Christians also believe in "Allah" until now.

6. So, from these arguments we can see that Raja Petra's arguments do not hold water. If he really cares about the faith of the Muslims and willing to protect its purity, then he should not go around confusing people with his writings especially on faith because with just one wrong move it can mean between being a Muslim or an apostate.

7. We commend the Government for taking crucial steps in stemming out this dangerous trend to 'liberalize' Islam in our beloved Malaysia.

1. Firstly, we would like to draw the attention of the citizens of Malaysia to not be confused by the articles written by Raja Petra Kamarudin on the use of the word “Allah” by Christians because Muslims have to be clear about the source of reference for Christianity – The Bible. If the current Bible is no longer the “real” Bible that was revealed to Jesus Christ, then all Muslims should never refer to it. Only scholars may use it to do a comparative study/research to counter the Christian propaganda.

The following explains the reasons why we should not refer to the existing Bible:

Contradictions in The Bible?

First and foremost, let me be perfectly clear on the position of Muslims regarding the authenticity of the Holy Bible. It is a condition of faith for believers to believe in all of God's Books and scripture as stipulated by the Quran, the Last and Final Testament from Almighty God to mankind, that the previous scriptures, including of course the Old Testament (Arabic = Torah), the Psalms (Arabic = Zabur) and the New Testament (Arabic = Injeel) were all from Almighty God (Arabic = Allah) in their original form. The beginning verses of the Quran clearly spell out the position of the 'Believer' with regard to these scriptures. As the translation from Arabic may be rendered regarding the conditions of believers:

"And they (believers) believe in what is being sent down to you (Muhammad, peace be upon him) and they believe in what has been sent down before (previous Holy scriptures to Abraham, Moses, David, Solomon, and of course Jesus, peace be upon them all)." [Noble Quran 2:4]

Therefore, it must be established that Muslims do accept that Almighty Allah did send down many Holy Books and he did allow the people to alter, change, delete and make additions to these Books, and as such, they can no longer be considered as the "Word of God" in their present condition. This is something immediately agreed upon by all qualified Biblical scholars.

Incidentally, there is sufficient evidence in the Quran to prove the remainder of the Bible still contains many of the original teachings and sayings of the prophets to whom the various scriptures were revealed.

From the previous chapter we can easily determine that the original source of the Bible, both the Old and New Testaments have been lost and are no longer extant in any language. What has remained and been referred to for translations, is in fact nothing more than old copies that do not necessarily agree with each other and there does exist in them obvious corruption in additions and deletions. Additionally, they are not complete and do not have full agreement of the scholars of the Bible as to their meanings.

Just to offer a few of the many contradictions and errors of that which is being presented as the "Word of God" in the Bible I would like to quote the research of scholars of the Bible:

John 10:29 - "My Father, which gave them me, is greater than all."
John 14:1 - Jesus said, "...believe also in me."
John 14:16, 17:1, 17:9, 17:11, 17:15 - Jesus prayed.
John 14:31 and 15:10 - Jesus followed commands.
John 17:6-8 - "I have given unto them the words which thou gavest me."
John 20:17 - Jesus had a god.
Acts 2:22 - Jesus was "a man approved of God."
Romans 8:34 - Jesus was an intercessor.
1 Timothy 2:5 - Jesus was the mediator between God and humans.

Incidentally, these are really only some selections of contradictions and inaccuracies found in the modern versions of the Bible. There are many more but for the sake of time and space we have limited ourselves to those listed above.

Again I would like to repeat, the Muslim must believe in all original texts coming from Almighty God. The only subject being discussed here is whether or not the Bible being offered today in the English language is in fact, the real "Bible".

2. Secondly, if the current Bible has been corrupted, the Christians cannot claim that the word “Allah” has been used since the time of Jesus Christ in the correct way. How can they prove that the word “Allah” has not been corrupted in meaning? That is why they have made ‘shirk’ to Allah s.w.t. by saying Jesus is the son of “Allah”. So, how can the Christians shamelessly use the word “Allah” and at the same time do not worship Him as it should, as we have explained in our article here. So, we strongly condemn all parties in Malaysia that allow the Christians to use the word “Allah” in any way and means.

3. Thirdly, we would like to comment on Raja Petra’s insistence and persistence in propagating this issue as follows:

3.1 If Raja Petra can write invigorating and explosive articles regarding the underworld crime syndicates and their Kingpins, why can’t he see through the bad Christian propaganda that is in Malaysia and Indonesia, to name a few?

3.2 Is Raja Petra biased on this issue? Is it because of his wife’s previous background? Or due to his upbringing? Or due to his Christian families and friends? Or all of that?

3.3 Of course Muslims believe that all Prophets were sent by Allah s.w.t. to mankind and they believe in one God, i.e. Allah s.w.t. But along the way many people strayed and did not worship Allah s.w.t. as they should, except the true followers of Prophet Muhammad s.a.w. and the Prophets a.s. before him. So, how can the Christians claim to use the word “Allah” without worshipping Him in the correct way? Let’s make a simple analogy, how can we call a person a King if we do not accept his attributes and dignity as a King and give him due respect? So now, who’s being stupid?

3.4 Waraqah Ibn Naufal was a true Christian. When he knew that Prophet Muhammad s.a.w. is the last Prophet and Messenger of Allah s.w.t. as the Prophet first met him telling him of his acquaintances with Gabriel, Waraqah supported him then. After meeting Prophet Muhammad s.a.w., Waraqah died a few days later. If he were alive until Prophet Muhammad s.a.w. received the first Quranic verses, surely Waraqah would have believed and supported Prophet Muhammad s.a.w. until the end. This is what a true Christian should do now once they have been shown the truth. But, Islam says that there is no compulsion in religion. So we do not force the Islamic faith on them or anyone for that matter.

3.5 The Holy Quran and our Prophet Muhammad s.a.w. say many times (we will not quote the references as these facts are already well known among Muslims) that Muslims should not be like non-Muslims especially in faith, deeds and character. Also, Christians and Jews will not give up their quest until the Muslims follow their way. So, we strongly advise the Muslims to not follow the Christians in this case for allowing them to use the word “Allah” because that would mean we are following their way and their way will confuse the ordinary people into thinking that worshipping “Allah” would be like how the Christians worship “Allah”. We would want to prevent any slightest corruption to our faith. We would want to purify our faith by not allowing this kind of issues to corrupt our minds and soul forever, as has been done by the ‘Salafus Saleh’.

4. Fourthly, we strongly recommend the Government to not only stay on their current stand in this matter but to fully ban all Christians from using the word “Allah” in any way and means. The bad Christians will use this approach to extend their evil propaganda without we even realizing it.

5. So, we recommend that all the Muslims who are involved in this treachery to repent because they are not only being traitorous to Allah s.w.t. but also to the Sultan Of Perak. The Sultan Of Perak is Allah s.w.t.'s Vicegerent in Perak as he is the Head Of Islam in his State. As for the non-Muslims, they have to redeem themselves as they are traitorous to the King and Country as spelled out in the 'Rukun Negara - Taat Kepada Raja Dan Negara' (Pillars Of State - Obedience To The King And State). Or else, the wrath of Allah s.w.t. shall befall on them soon, inshaAllah.

6. As for Karpal Singh, Mohd Nizar and the likes, we recommend that the Sultan Of Perak revoke all their honorary titles and ban them from entering Perak until such time that they have turned a new leaf, if they do not make a public apology within 48 hours.

Our Comment:

1. We commend Datuk Seri Abdullah for spearheading the motion to urge the United Nations to setup an international tribunal to bring Israel for her war crimes against the Palestinians. Ehud Olmert, Ehud Barak and George W Bush amongst them should be tried for their war crimes against the Palestinians. Also, he urged the UN to deploy peacekeeping forces to effect a ceasefire and maintain peace in the region.

2. We also commend all Malaysian Parliamentarians for supporting this cause to the fullest especially Datuk Seri Anwar Ibrahim.

3. Again, we strongly condemn the Israelis and their supporters to the bones for their atrocities towards the Palestinians. They even went to the extent of torturing the Palestinians using white phosphorus.

4. May Allah s.w.t. befall His wrath on these terrorists and war mongers soon, inshaAllah.

5. If the United Nations fails in resolving this recent conflict in Palestine, the UN cannot stop other international bodies especially the OIC or Arab League in taking steps and actions to safeguard the peace and stability in the region. To this effect, we strongly call upon the international bodies to setup a peacekeeping force for deployment in the region to protect the innocent and the oppressed Palestinians. The UN must not stop this peacekeeping efforts if she fails to perform her duties in this humanitarian crisis.

6. We reiterate our full support to Datuk Seri Abdullah to be the PM of Malaysia at least until 2010 because he has shown to the people that he is a capable leader in leading this country against aggression and oppression in this World. So, we confer our full agreement on him to be the PM until 2013.

7. Datuk Seri Abdullah can hold a national referendum to seek the support of the citizens of Malaysia to enable him to continue to be the PM of Malaysia until 2013, inshaAllah.

KUALA LUMPUR, Jan 8 - Catholic newspaper The Herald will mark the return of its Bahasa Malaysia edition with a bumper issue next Jan 18 and defy the authorities by using "Allah" to describe God.

Herald editor Rev Father Lawrence Andrew said today it will use the word "Allah" as its suit on the word is still in the courts while the bumper issue is to make up for lost time. Government officials said the newspaper can have a Bahasa Malaysia edition as long as it does not describe God as "Allah" which is reserved only for Muslims.

"We will continue using it as the case is still going on in court," Fr Lawrence told The Malaysian Insider today, adding the Kuala Lumpur High Court had allowed The Herald to continue using the disputed word pending its judgment in the case.

Synopsis

From the meaning of the Law above, the important explanations are as follows:

1. Islamic Law is the decree (‘Khitab’) of Allah s.w.t. regarding the actions of human beings only

2. The actions of human beings are:

3. No human being can run away from the Laws of Allah s.w.t.

Categories Of Islamic Law

1. ‘Taklifi’ Law

The Differences Between ‘Taklifi’ Law And ‘Wadh’i’ Law

The differences between the above 2 categories of Law are:

1. ‘Taklifi’ Law is in the form of commands to do something or in the form of giving a choice. ‘Wadh’i’ Law is in the form of associating a cause or condition or ‘Maani’ (obstacle) in determining a certain Law

2. ‘Taklifi’ Law is in the form of commands to do something or in the form of giving a choice of doing something that is able to be carried out by any ‘Mukallaf’. Some of the ‘Wadh’i’ Law are only able to be carried out by a portion of the ‘Mukallaf’

3. ‘Taklifi’ Law is only applicable to ‘Mukallaf’. Whereas Wadh’i Law is applicable to all human actions, whether ‘Mukallaf’ or not.

Types Of ‘Taklifi’ Law

There are 5 types of ‘Taklifi’ Law:

1. ‘Wujub’ : ‘Khitab’ of Allah s.w.t. in the form of a command to do something in a ‘Jaazim’ (obligatory) way

2. ‘Nadb’ : ‘Khitab’ of Allah s.w.t. in the form of a command to do something in a non-‘Jaazim’ way

3. ‘Tahrim’ : ‘Khitab’ of Allah s.w.t. in the form of a command not to do something in a ‘Jaazim’ way

4. ‘Karahah’ : ‘Khitab’ of Allah s.w.t. in the form of a command not to do something in a non-‘Jaazim’ way

5. ‘Ibahah’ : ‘Khitab’ of Allah s.w.t. in the form of giving a choice to do something or not to do something

From the 5 types of ‘Taklifi’ Law above arise 5 types of actions of the Law, that is:

1. ‘Wajib’ : Action that contains the ‘Wujub’ law

2. ‘Mandub’ : Action that contains the ‘Nadb’ law

3. ‘Haram’ : Action that contains the ‘Tahrim’ law

4. ‘Makruh’ : Action that contains the ‘Karahah’ law

5. ‘Mubah’ : Action that contains the ‘Ibahah’ law

Doing the ‘Wajib’ action is accorded a reward (‘Pahala’) and not doing it is accorded a sin (‘Dosa’). Doing the ‘Mandub’ action is accorded a reward and not doing it is not accorded a sin. Doing the ‘Haram’ action is accorded a sin and not doing it is accorded a reward. Doing the ‘Makruh’ action is not accorded a sin and not doing it is accorded a reward. Doing the ‘Mubah’ action and not doing it is not accorded a sin or reward.

Categories Of ‘Wajib’

‘Wajib’ can be divided into a number of groups if viewed from these perspectives:

1. Time of action

2. Quantity of action

3. Human being doing the action and

4. Type of action

From The Perspective Of Time Of Action

From the viewpoint of the time of action, ‘Wajib’ can be divided into:

1. ‘Wajib Mutlaq’ : ‘Wajib’ that is not bound by a certain timeframe

2. ‘Wajib Muqaiyad’ : ‘Wajib’ that is bound by a certain timeframe

2.1 ‘Wajib Muwassa’ - The time allocated is more than doing one action. Eg. Prayers

2.2 ‘Wajib Mudhaiyaq’ - The time allocated is just enough for one action. Eg. Fasting

2.3 ‘Wajib Zu Shubhaini’- ‘Muwassa’ from one perspective and ‘Mudhaiyaq’ from another perspective. Eg. Pilgrimage

Important Note

From the categories of ‘Wajib’ above, arise 3 important issues:

1. Fulfilled (‘Tunai’ or ‘Adaa-an’) Action - Action done in the allocated time

2. Repeated (‘Ulangan’ or ‘I’adah’) Action - Action done once again or more in the allocated time

3. Replaced (‘Ganti’ or ‘Qadha-an’) Action - Action done outside the allocated time

From The Perspective Of Quantity Of Action

From this perspective, ‘Wajib’ is divided into:

1. ‘Wajib Muhaddad’ - Action that has been specified the quantity

2. ‘Wajib Ghairu Muhaddad’ - Action that has not been specified the quantity

From The Perspective Of Human Being Doing The Action

From this perspective, there are 2 groups of ‘Wajib’:

1. ‘Wajib ‘Aini’ - Action needed to be done by everyone

2. ‘Wajib Kifaa’i’ - Action needed to be done by a specified group of people

Types Of ‘Wajib ‘Aini’

1. ‘Wajib ‘Aini’ that cannot be replaced by anyone else i.e. all actions relating to the body (‘badaniyah’)

2. ‘Wajib ‘Aini’ that can be replaced by someone else i.e. actions relating to property

3. ‘Wajib ‘Aini’ that can be replaced by someone else if disabled (‘Uzur’) i.e. actions relating to the body and property

From The Perspective Of Type Of Action

From the perspective of the action itself, ‘Wajib’ is divided into 2:

1. ‘Wajib Mu’aiyan’ - Specific action without any other choice

2. ‘Wajib Mukhaiyar’ - Action that can be chosen from a number of specified actions:

2.1 Can do only one action

2.2 Can do more than one action

Categories Of ‘Mandub’

There are 3 groups of ‘Mandub’:

1. ‘Mandub Muakkad’ - Leaving it is not a sin but is accursed and reprehensible like:

1.1 Actions escorting the ‘Wajib’

1.2 Actions always done by Rasulullah s.a.w. He left
them once in awhile only

2. ‘Mandub Mashruu’ - Leaving it is not a sin and not accursed and not reprehensible like the actions done by Rasulullah s.a.w. once in awhile only

3. ‘Mandub Zaaid’ - Leaving it is not a sin and not accursed and not reprehensible but is not complete, elegant, magnificent and comfortable like the way Rasulullah s.a.w. eats, walks, sleeps and dresses

This ‘Mandub’ is also called ‘Mustahab’, ‘Adab’ and ‘Fadhilah’

Categories Of ‘Haram’

Action and things that are ‘Haram’ are divided into 2:

1. ‘Haram Li Zaatihi’ - ‘Haram’ because of the essence of the action or thing itself

2. ‘Haram Li Ghairi Zaatihi’ - ‘Haram’ because of something foreign that has attached to it, whether the attachment causes:

2.1 ‘Haram’ forever or

2.2 ‘Haram’ temporarily

Types Of ‘Wadh’i’ Law

There are 3 types of ‘Wadh’i’ Law:

1. Cause - Clear specific characteristic that forces the existence of a certain law

2. Condition - Clear specific characteristic that allows for a certain law

3. ‘Maani’ - Something that when exists, thus there is no concerned law based on a certain cause

This ‘Maani’ is as if it nullifies an existing law based on a certain cause

The Difference Between Cause And Condition

A cause is with its existence there must be a certain law and without its existence there must be no law. Whereas a condition is without its existence there must be no law and with its existence there is not necessarily a law or no law.

Categories Of Cause

Categories of cause can be done from 2 aspects:

1. From the aspect of its effect on the law and

2. From the aspect of the ability of the human being on the cause itself

From the aspect of its effect on the law, cause is divided into 2:

1. Cause that clarifies a certain ‘Taklifi’ Law and

2. Cause that clarifies ownership or loss of it or clarifies the permissibility of something or the impermissibility of something

From the aspect of the ability of the human being on the cause itself, cause is divided into 2 groups:

1. Cause that human beings are able to realize and

2. Cause that human beings are unable to realize

Categories Of Condition

Condition is divided into 2:

1. Condition for a certain law

2. Condition for a certain cause of law

Types Of Condition

There are 2 types of condition:

1. ‘Shar’i’ Condition - Condition that has been specified by Islamic Law

2. ‘Ja’ali’ Condition - Condition made by human beings themselves but is not in contradiction with the principles and methodology of Islamic Law

Categories Of ‘Maani’

‘Maani’ is also divided into 2:

1. ‘Maani’ for a certain law

2. ‘Maani’ for a certain cause of a law

Principles Of Law

What is meant by Principles Of Law here is “The basics that form the foundation of a certain Law”. It can be divided into 2 groups:

1. General Principles that encompasses all fields such as:

1.1 ‘Adamul Haraj’ (Not suffering)

1.2 ‘Qillatut Taklif’ (Reducing the burden)

1.3 ‘Al-Akhlaq’ (Morality)

1.4 ‘Al-Musaawah’ (Equality)

1.5 ‘Al-‘Adl’ (Justice)

1.6 ‘Al-Masoleh Al-‘Ammah’ (Public Interest)

2. Specific Principles on certain fields only such as:

2.1 ‘Ash-Shura’ (Consultation) in the field of Governance

2.2 Ownership in the field of property

2.3 Inheritance in the field of family relations

Methodology Of Law

What is meant by Methodology Of Law here is “Methods to identify the derivation of Law or methods to implement something that the Law applies”. It can be divided into 2 groups:

1. ‘Qawaa’id Kulliyyah’ - Methods to identify the derivation of Law. For example, through:

1.1 Difficultness brings easiness

1.2 Harmfulness needs to be eliminated

1.3 Tradition sometimes becomes the judge

1.4 All affairs are based on objectives

1.5 No reward for any action except because of Allah s.w.t.

1.6 Confidence cannot be eliminated when there is doubt

2. ‘Qawaa’id Juziyyah’ - Methods to implement something that the Law applies. There are 2 types for these methods:

2.1 The fixed cannot be changed i.e. the implementation of ‘Iman’ (Faith), ‘Ibadah Mahdhah’ (Prayers, Fasting, Pilgrimage), ‘Nikah’ (Marriage), ‘Talaq’ (Divorce), ‘Faraaid’ (Inheritance Laws) and ‘Hudud’ (Penal Code)

2.2 Can be changed according to the current suitability and situation

‘Maqaasid’ (Objectives) Of Islamic Laws

The objectives of Islamic Laws are seen from the combination of 2 sides. That is, the side of the one specifying the Laws and the human side that the Laws apply to.

In general, the objectives of the Islamic Laws are to create the benefits that bring happiness for all mankind in this World and in the Hereafter. Even though there are many human benefits, they are not out of the following 3 groups:

1. ‘Dharuriyat’ - All that are a must for existence of mankind. If there is no ‘Dharuriyat’, then there will be human destruction, loss of amenities, suffering in this World and punishment in the Hereafter. The ‘Dharuriyat’ matters are:

1.1 Preservation of Religion

1.2 Preservation of Mind

1.3 Preservation of Life

1.4 Preservation of Offspring (Honor) and

1.5 Preservation of Property

2. ‘Haajiyat’ - All that mankind needs to avoid ‘Mashaqqah’ (hardship). Without ‘Haajiyat’, mankind will face hardship in life, even though life itself is not destroyed

3. ‘Tahsiinaat’ - All matters that qualifies and are proper for magnificent morality, esteemed dignity and beautiful tradition

INTRODUCTION

The Meaning Of Islamic Jurisprudence

What is meant by Islamic Jurisprudence here is:

“A study regarding matters that are related to the Laws that have been defined by Allah s.w.t. as a guidance for the whole of mankind in all fields of their lives, as seen from the aspects of activities, relations and needs.”

Synopsis

From the meaning above, we can summarize as follows:

1. Islamic Jurisprudence is a study on Islamic Laws

2. Islamic Laws are the decrees of Islam

3. Islamic Laws are a guide for the whole of mankind

4. Islamic Laws encompasses the whole way of life of mankind

5. The scope of human activities includes:

5.1 Activities of the body

5.2 Activities of the soul

5.3 Activities of the senses

6. The scope of human relations are:

6.1 The relation of mankind with Allah s.w.t.

6.2 The relation of mankind amongst them

6.3 The relation of mankind with nature (and other creatures) and

7. The scope of human needs are either:

7.1 The needs of the body

7.2 The needs of the soul or

7.3 The needs of the body and soul,

which encompasses the aspects of economy, social, political, etc.

The Periodic Stages Of Islamic Jurisprudence

In general, there are 6 periodic stages of Islamic Jurisprudence, that is:

First Stage

From the time of the Prophethood of Rasulullah s.a.w. in the year 610 AD until the year 632 AD (11 H). This stage is known as the time of Rasulullah s.a.w. or the time of the growth of the Islamic Laws. Therefore, there existed 2 stages of the growth:

• When Rasulullah s.a.w. was in Mecca for 12 years and a few months and

• When Rasulullah s.a.w. was in Medina, i.e. about 10 years.

Second Stage

From the year 11 H (632 AD) until the year 40 H. This period is known as
the era of the 4 Rightly-Guided Caliphs r.a. or the era of the interpretation of the Islamic Laws.

Third Stage

From the year 41 H until the end of 100 H. This stage is considered the era
of the birth of the schools of political thoughts (‘Mazhab Siasah’). These schools of thoughts are the:

• Shiah,
• Khawarij and
• Jumhur (Ahlus Sunnah Wal Jama’ah)

Fourth Stage

From the beginning of the year 101 H until the year 350 H. This stage is the
era of the emergence of the ‘Mujtahid’ (An Islamic scholar who is competent to interpret divine law or ‘Shariah’ in practical situations using ‘Ijtihad’ or independent thought) and the era of the compilation of knowledge in book form. Among the knowledge that were written:

• Grammar
• Semantics
• Literature
• Astronomy
• Hadith
• Fiqh (Jurisprudence)
• Philosophy
• Medicine
• Agriculture, etc.

This era also saw the birth of 2 schools of juristic thoughts (‘Mazhab Fiqh’), i.e.:

• Hijaziyun (The Scholars of Hadith)
• ‘Iraqiyun (The Scholars of Logical Thought)

Fifth Stage

From the year 350 H until the year 656 H. This stage was about the loss of
‘Mujtahid Mutlaq Mustaqil’ (Absolute and Independent Mujtahid) and the start of ‘Taqlid’ (Juristic Imitation). This was because the Islamic Scholars were focusing on:

• Disapproval of laws
• Affirmation and recommendation of laws
• Ensuring the success of a certain school of thought

Sixth Stage

From the year 656 H which was the fall of the city of Baghdad until now. This stage can be considered as the era of ‘Taqlid’ maturity.

Our Comment:

1. These statements "If that was really what God intended then God did not do a good job. Those who deserve punishment certainly did not get punished. Those who were punished were not deserving of that fate." in this article are outright blasphemy. May the author repent and be forgiven by Allah s.w.t. A true Muslim will not question Allah s.w.t. i.e. Qadha and Qadar. The limited knowledge of mankind most of the time cannot explain the Wisdom of Allah s.w.t. in governing this Universe.

Just take the simple example of the 3 cases of the actions of Prophet Khidr a.s. as told in the Holy Quran (Chapter 18: Verses 60-82) when Prophet Moses a.s. followed him. This shows that only Allah s.w.t. knows best and only He can guide whoever He so wishes to wisdom. In this case, Prophet Khidr a.s. and Prophet Moses a.s.

2. As we have said before in our article, disbelieve among Muslims on any Islamic Law will nullify their Shahadah. They ceased to be a Muslim once they disbelieve, ridicule or do not accept any Islamic Law.

3. As the author of this article in Malaysia Today throws many misconceptions about Islam that can deceive the public, we have no choice but to embark on an effort to present Islamic Jurisprudence to the people in the manner that it should be understood so that they may not be ignorant about Islam anymore. 5. The EC (SPR) is still not a truly independent body. During the last GE, postal votes were still being used to win the BN candidates. As long as there are gerrymandering and abuse of postal votes, the General Elections in Malaysia are still not transparent and fair enough. With this, Malaysia will never be a truly democratic country as per World standards on general elections.

SHAH ALAM, Nov 7 — The High Court today ordered that Raja Petra Kamarudin, editor of the popular news portal Malaysia Today, be released from detention after ruling that his arrest for allegedly causing racial tensions was unlawful.

High Court Justice Syed Ahmad Helmy Syed Ahmad ruled that the Home Minister acted outside his powers in having Raja Petra arrested on Sept 12, said the blogger’s lawyer Malik Imtiaz Sarwar.

He quoted the judge as saying the grounds given for Raja Petra's detention were insufficient and that his arrest under the Internal Security Act was unlawful.

1. We strongly recommend that the Government be on a thrift budget for 2009 rather than on a 'spendthrift' one in the wake of the economic recession. Do not use the logic of following other countries when we know that they are not perfect and have faltered lately.

2. We make this call based on the Islamic principle of thriftiness. Also, we can take the example of Prophet Joseph a.s. where he put his country then on a thrift budget knowing that they would face hardship in the land at that time.

1. We strongly condemn all UMNO & Ex-UMNO members to the bones for asking/giving/taking bribes in the UMNO elections, be it in the past or present.

2. We would like to remind them that involving in bribes is a big sin. Islam says that whosoever gives or takes bribes, both of them will go to Hell. So, are the UMNO members serious about being good Muslims or are they just want to make lots of bad money? If the answer to the latter question is yes, then their future are doomed, especially in the Hereafter.

1. We saw the President of MUBARAK on TV last night. He looked really concerned about the future of UMNO and Malaysia.

2. Being an ex-People's Representative, he very well know that the people must come first before oneself or the party that they represent. However, we have two (2) reservations on him as follows:

2.1 He said that Muhyiddin has been consistent all this while in asking Abdullah to step down. We think that Muhyiddin is not being rational enough. We know that he has been asking Abdullah to step down even before the 12th GE. But when a consensus has been made, he should not have repeated his call in public. This is the spirit of consensus and teamwork. This was not reported by BERNAMA.

2.2 He also said that Najib is right in saying that the transition plan is for the delegates to decide and endorse. We do not question the rules in UMNO, but we question as in 2.1, the spirit of the mutual understanding and agreement made by all the MT members in the meeting. Once an agreement has been made, one cannot betray this decision although one is still not in favor of it because the majority has spoken. However, this does not mean that this matter cannot be tabled in the upcoming Convention. At the moment, all MT members must refrain from going against the consensus. This is the correct spirit in a well-organized body.

3. So, we recommend the members of UMNO to take a crash course on the disciplines of meeting, consensus and teamwork in an organization. It seems that they are so lacking in this area and are causing the split and chaos in UMNO now, amongst them.

1. We strongly condemn the Police Force to the bones for using ISA on Raja Petra, Teresa Kok and Tan Hoon Cheng. This is a final warning to all those who propagate ISA by using detention without trial on Malaysians. Normally, we only give advise/chance 3 times. After that, we do not care anymore to those who do not want to listen. It is up to their fates from now on.

2. This latest string of ISA arrests are the work of Dr Mahathir, Musa Hassan and their cohorts. They know that if Abdullah pushes through with his reform agenda in this country, their days are numbered. So, they are very desperate and want Abdullah to step down and disappear into oblivion. They are more afraid of Abdullah than Anwar because Abdullah is going to restore the original rights and powers of the Malay Rulers, reform the Judiciary, reform the ACA, reform the Police Force and etc. Also, as an insider, Abdullah knows very well all their 'skeletons in the closets'.

3. Let's look at Dr Mahathir's moves. First, he accuses Abdullah of the rising racism in this country. Second, he caught hold of his anchor man Muhyiddin to do his bidding in UMNO, since he has already lost Najib. Third, he instructed Musa Hassan & cohorts to implement the latest strings of ISA arrests. There may be more to come. The next move is to re-enter UMNO.

4. As we have said earlier, 'Sodomy 2' was also his bidding and now this 'Operation Lallang 2'. We can clearly see his pattern of strategies. These are the same old dirty tricks. So, in fact, Dr Mahathir and his cohorts are the real enemies of Islam, Malaysia and her citizens, as we have said before.

1. We strongly condemn Muhyiddin to the bones for asking Abdullah to step down as PM.

2. Muhyiddin has been 'duped' by Dr Mahathir like Raja Petra.

3. So, we strongly recommend Abdullah to ask Muhyiddin to resign or if he does not want to, sack him, as said by Zaid. There is no point keeping a 'thorn in the flesh' in the Cabinet. He can do more damaging things in the future.

Here are some family advise for Raja Petra, if he cares to listen.

1. Najib is right in making the call for unity. This is one of the pre-requisites of being a good leader. Bad leaders always create chaos, confusion and fear among the followers.

2. Islamic Scholars take years to study, comprehend, absorb and implement the exemplary and wise Islamic Governance as shown by Rasulullah s.a.w. and His Companions r.a. They are our best generation and model. Does Raja Petra think that with a mere few words/sentences/paragraphs, he can summarize and paint a true and complete picture of them? We think not. His writings on Islam lack the credibility and essence in the subject matter.

Mind you that any form of denigration or ridicule on Rasulullah s.a.w., His Family and His Companions r.a. is a big sin, however small it may be. That's why Islamic Scholars do not simply make unscrupulous and uncontrolled statements about them.

3. We despise Dr Mahathir not because of him as a person but because of what he has done to our family, Malaysia and her citizens. If Raja Petra can still kiss his hand, then something is really really wrong here. We have X-rayed Raja Petra and found that a few of Dr Mahathir's devils are following Raja Petra around wherever he goes. They tried to harm us yesterday but to no avail. So, we strongly recommend that Raja Petra quickly seek treatment before it is too late.

Now, we are also thinking of Tengku Razaleigh. Will he befall the same fate as Raja Petra when he meets with Dr Mahathir?

4. Raja Petra said to Hamid Albar not to be Allah s.w.t.'s Assistant. Every averagely knowledgeable Muslim knows that this is 'shirk'. Why bring this up? We should not dwell on critical matters that can stray the 'Aqidah' of the Muslims, taking the lessons from what Allah s.w.t. forbids us to not even approach fornication, let alone do it. So, stay away from harmful statements that can threaten the faith.

5. Does Raja Petra wants Allah s.w.t. to directly talk to him like Prophet Moses a.s.? Maybe only then Raja Petra will know whether he is right or wrong. Nowadays, we settle such matters in the Syariah Courts. Can Raja Petra do that and not leave it to Allah s.w.t. to decide?

6. Raja Petra mentioned Hell in his article on Altantuya's murder. Only Allah s.w.t. can decide who goes to Hell and who does not. So, in this latest article of his, who is playing God?

All of the above shows that there is something terribly wrong with Raja Petra's psychological and spiritual states. It would not be a surprise if he may even give our name(s) to Dr Mahathir, be it directly or indirectly. Go get treatment immediately.

Our Comment:

1. We strongly protest to the Government not to charge Raja Petra under ISA. As the Government is well aware, we strongly oppose ISA to the bones.

2. We do not agree to the following statements made by Raja Petra in his article in question:

"Then they do everything that Islam is against without blinking an eyelid as if this is what God Himself prescribed.

But only Muslims pretend to be good when they are actually bad. Only Muslims talk about their religion non-stop while going against everything their religion stands for.

Muslims do not know how to be Muslims. Muslims do everything Islam is against. Muslims are hypocrites."

These are very dangerous statements. A devout Muslim should not simply throw these kinds of statements to the public. If these statements are not true, then the result is that whatever is being said will come back to the person who has made these statements. As we have cautioned before on safeguarding our 'Shahadah', accusing a Muslim to be a 'kafir', apostate or hypocrite is prohibited in Islam. We do not want the reverse effect to befall the accuser.

3. So, we strongly recommend the Government to charge Raja Petra in the Syariah Court as this concerns Islam. They have to be very objective and put the proper perspective around Raja Petra that has led him to be in his current state of mind. As we have said before, Raja Petra has been duped by Dr Mahathir. Until Raja Petra seeks treatment, his condition will worsen and his family will be affected.

4. A number of his commentators in Malaysia Today are equally responsible for these insults. So, if Raja Petra cannot control and guide his commentators, then he should be willing to shoulder the responsibility that he has created an atmosphere for these insults to Islam to occur.

5. Therefore, Raja Petra should refrain himself from stereotyping Muslims and using a 'westernized' approach to talk about Islam. Let Islam be propagated in a dignified and glorified approach as done by the 'salafus salih'. We are not against Malaysia Today or Raja Petra for that matter in this case. He should realize that his strong point is exposing corruption and wrong doings in the Government and elsewhere and his weak point is his understanding of Islam as a complete way of life and his approach of propagating 'Da'wah'.

Is It dangerous To Eat Fish?

1. Normally, it would be a healthy diet practice to eat lots of fish. However, of late we have been hearing many people say that the fish in our Malaysian markets and shops are laced with a dangerous chemical.

2. This chemical is called formaldehyde. It is popularly used to preserve dead bodies. This chemical is known to be linked to a cause of cancer. The complaints of people are that fishermen use this chemical and inject it into the fish to preserve it from going bad faster.

3. Among the ways to identify this chemically-laced fish are that we can see it appears lustrous and fresh and flies would not even want to come close to this fish, let alone feed on them. In fact, we stumbled upon this case last Sunday 31-Aug-08 when we suspected the hard tail mackerels ('cencaru') in one of the TESCO hypermarkets in the Northern Region looked like they have been spiked. After 'X-raying' these fish, we confirmed that they were indeed chemically-laced with formaldehyde.

4. We strongly urge the Government to take appropriate actions to curb this unhealthy and unsafe practice among fishermen, especially from Thailand. Also, fish distributors and retailers should not sell these chemically-laced fish to the citizens of Malaysia by sacrificing the health of the people with just mere profits.

Our Comment:

1. We are of the opinion that Tengku Razaleigh is wrong in making the call to defeat Abdullah in the UMNO party elections this coming December. He should work with Abdullah to improve and strengthen UMNO and not take steps to undermine the unity of UMNO members. Although Tengku Razaleigh is family, but national interests come above family interests.

2. The root cause of UMNO's problems is its members themselves. Not all are like Abdullah, Mohd Najib and Tengku Razaleigh. There are members who are like Dr Mahathir also. So, Abdullah's team must defeat, subdue and win over Dr Mahathir's team. Only then will UMNO regain its reputation like before the 80's.

3. Tengku Razaleigh, although a Royalty, is not at par with Abdullah, especially in Islamic credentials. Our benchmark for Abdullah is his grandfather, the late Sheikh Abdullah Fahim. Our benchmark for Tengku Razaleigh is the late His Highness Sultan Abdul Hamid Halim Shah. The more both of them inch towards these benchmarks, the better they become. The better they become, more people will follow them to become better. That's why leaders must have impeccable qualities so that people can emulate and follow them.

4. Changing the leadership of UMNO will not solve its problems at the root. Putting Tengku Razaleigh or Dr Rais at the helm will not resolve the current crisis in UMNO. UMNO has to undergo a total transformation to bring it back to the good old days, at least in spirit. Only then UMNO will be revived. History has shown that revivalism is a natural part and parcel of the improvement cycle.

5. We pray that Abdullah will win the UMNO presidency again, will unite the UMNO members again and will revive UMNO again to where it once used to be respected and lead our country to greater heights. Only Abdullah can do this within UMNO and not like Dr Mahathir who has betrayed and abandoned UMNO. Our undivided support to Abdullah is to the end.

THE Bar Council wants the government to withdraw the Deoxyribonucleic Acid (DNA) Identification Bill 2008, arguing that it removes the court's jurisdiction to determine the validity of DNA information tendered as evidence.

The Bar's Human Rights Committee chairman Edmund Bon said Section 24 of the bill would allow any information from the DNA databank to be admitted as conclusive proof in any court proceeding.

1. We strongly protest to the Government to stop making unjustified and abusive amendments to the DNA Bill. We shall hold the Home Minister Hamid Albar responsible for this transgression. If anyone in Malaysia is being unjustly persecuted due to these amendments, we will pray to Allah s.w.t. so that the Al-Mighty invokes His wrath onto Hamid Albar and all those who are involved in passing these amendments.

2. We greatly commend the The Bar Council for highlighting and protesting this issue to the Government and to the people of Malaysia. We consider that The Council has redeemed itself by taking up this issue. This will restore The Council's image in the eyes of the public.

3. We always propagate the concept of "To err is human, and to forgive is divine". So, we have nothing against The Council now. Our only advise to The Council is to perform a FMEA (Failure Mode & Effects Analysis) first on any issue before bringing it up to the public for an open debate. This will ensure that there will be no adverse effects and collateral damages down the line.

1. We strongly condemn Muhammad Shafee Abdullah to the bones for denigrating Raja Petra, our family. He is a Royal and no one can change that. 1. Tuan Guru Nik Aziz is right. Tuan Guru Abdul Hadi is right. Dr Haron Din is right. Dr Asri is right. Raja Petra is also right.

2. But, as we have said before, Tuan Guru Abdul Hadi is right in saying that both Anwar and Saiful should take this matter to the Syariah court. Anwar has done so. When will Saiful do it?

1. Ghazali Sheikh Khalid, the Malaysian Ambassador to US, has been involved in the scandal with Jack Abramoff and associates in the US to receive bribes amounting to USD1.2 million from the Malaysian Government then for setting up Dr Mahathir's meeting with Bush in year 2002. So, Ghazali is a corrupted official and does not deserve to represent Malaysia in the US. Also, he is Dr Mahathir's cohort. Why is Abdullah Haji Ahmad Badawi re-electing him for this post? We strongly urge the US Government to protest on this re-assignment.

2. We oppose the amendment to the DNA Act that allows the Police or any other authority to forcefully take the DNA sample of a suspect in criminal cases or any other case for that matter. This is a violation of the individual rights of a human being. A human being should be treated with respect and dignity. So, if the suspect gives his/her DNA sample willingly, then that is alright.

The way that the PDRM, AG's Chambers, lawyers and the Judiciary in Malaysia are acting, we do not see that the preparation and test of the DNA sample will not be abused and tampered with. Without rampant snatching of one's DNA sample, the 'bad hats' in the Government cannot frame innocent people in Malaysia.

3. We are against the opinion of Dr Mashitah Ibrahim that allows one to make loans to perform the Haj or Umrah. It is not right to do so since Allah s.w.t. has decreed that performing the Haj is mandatory only for those who are able to do so. Furthermore, performing the Umrah is only optional. Whereas, Dr Mashitah Ibrahim is teaching the Muslims to learn making loans just like drinking water. For this purpose, it is wrong. What if the person after performing the Haj or Umrah dies before completing the loan repayment? Would that put more burden on the deceased and his/her family in this life and the Hereafter? Do not burden the Muslims in Malaysia with what Allah s.w.t. has made easy for them.

Think seriously and deeply about this, Dr Mashitah, and do not follow your whims and fancies. No wonder the Government can use the 'Islam Hadhari' label to insult Islam. Look at all these advisors around the PM. What a shame?

1. Some of the lawyers in the Bar Council think that they are smart and experts in law. So, they are indirectly trying to question and test the Syariah laws and its provisions in the Constitution of Malaysia. They think that Islamic matters pertaining to religious conversion, inheritance, marriage, etc. can be addressed by the civil courts.

2. We condemn these lawyers for their abusive and irresponsible acts for holding the forum. We are very angry at them for not being sensitive and considerate enough to the feelings, sentiments and norms of the Muslims in Malaysia. Because of this handful of lawyers, the Bar Council's reputation has been tarnished.

3. All Islamic matters shall be addressed in the Syariah courts. The civil courts do not have jurisdiction over these matters as specified in the Constitution of Malaysia.

4. The Bar Council should have conducted the forum in a different approach instead based on an inter-faith dialogue like the one mooted by the King of Saudi Arabia in Spain recently.

5. We do not mind if Islam and Islamic issues are discussed among experts in this way for the masses to see and participate. This approach will bring more good to the people rather than adverse effects.

1. As we have said before, we support Abdullah for UMNO President and Najib for UMNO Deputy President. Whoever does not agree has the same opinion as Dr Mahathir. Well, we can say that they are in his camp, although he is not in UMNO but his cohorts still are.

1. We support this article on corruption. As we have said before, corruption does not only involves money, it can also involves the mind, body and soul. That is why Islam always stresses the purification of the heart and soul. Our Prophet Muhammad s.a.w. took 13 years to do that. We will definitely take longer than that. So, the purification of the heart, mind and soul is a long and continuous improvement process that has no end. Only a pure heart, mind and soul will translate into good and sincere deeds.

1. We strongly condemn Dr Mahathir for insinuating that the current Government is behind this conspiracy to frame Anwar with the sodomy charges. It is Dr Mahathir and his cohorts who are trying to frame Anwar now. This current conspiracy of Dr Mahathir is like 'killing two birds with one stone'. Dr Mahathir knows that Abdullah & team and Anwar & team are coming after him. We are also coming after him for abusing the Malay Rulers, the people and the Nation. So, Dr Mahathir is under great pressure now and at any time may give way and leave us forever. So, he does not have a new proven tactic that works to frame both Abdullah and Anwar at the same time so he is using his old tactic again. He knows that this tactic had worked before and had disgraced him. This is his strategy now.

2. The story purported by Dr Mahathir is not genuine but the conspiracy of Dr Mahathir to frame both Abdullah and Anwar is genuine. Abdullah and the top echelons of UMNO did not even know that this conspiracy was coming. Anwar made a mistake for not ruling out the possibility that the 'double-edge' sword (Saiful, the mole) has been used against him now. So, how can Abdullah be behind this conspiracy to frame Anwar? This conspiracy must be coming from someone who is not in the Government and UMNO now. It is Dr Mahathir.

3. Saiful is a newbie to politics. He cannot be a copycat. The copycat is Dr Mahathir. Once a dictator always a dictator. Saiful lost face because Anwar found out that he was a mole. So, he had to redeem himself by following Dr Mahathir's wishes. Furthermore, he was given money to make the sodomy allegations on Anwar. So, money dictates. Yes, old habits die hard. So, Dr Mahathir's old habits die hard. He is a dictator and will always be until he dies. He is a greedy person until he dies. He also uses black magic until he dies.

4. Dr Mahathir is lying through his teeth about the previous sodomy allegations on Anwar. Anwar is innocent. Dr Mahathir himself said that Anwar did not do anything wrong and he had to catch Anwar and put him in jail because at that time he was in power. This is a typical character of a dictator.

5. Dr Mahathir is squirming and feeling the heat now. He knows that his conspiracy of framing Anwar the last time round has been exposed to the World. So, in vengeance, he is using this same conspiracy to frame both Abdullah and Anwar at the same time. This vindictive character is also reminiscent of a dictator.

6. Anwar will swear in the Syariah court and no where else. Dr Mahathir can plant his cohorts in the mosque. Who can guarantee this will not happen? Knowing his evil and vindictive nature, we must never trust the Police, Judiciary and Dr Mahathir's cohorts. We can trust Abdullah, Anwar and Najib. Furthermore, the Syariah courts are under the jurisdiction of the Malay Rulers. So, Dr Mahathir is trembling crazily when the Malay Rulers are involved. That's when we also come into the picture. So, Anwar is right in going to the Syariah court to lodge the 'Qazaf'. Mind you, this is no mere smokescreen. This is what Allah s.w.t. has prescribed to resolve such cases.

7. So, in fact, Dr Mahathir is playing with the religion of Islam by quoting Quranic verses and what not. Justice in this case is not to frame Abdullah and Anwar. Justice is this case is not to use the Police to harass Anwar and his family. Justice in this case is not to fabricate evidences. Can our current security and judicial systems assure Justice will be served fully?

If Dr Mahathir does not play with Islam, why does he get involved in black magic? During his tenure as Prime Minister, he used to engage the services of 'Pak Dak' the wizard. Now, he has a number of wizards and witches under his bidding. So, to us, if a person is involved in black magic, we cannot believe anything he/she says forever. 1. We confer our agreement and support for Abdullah to run for UMNO President and Najib for UMNO Deputy President.

2. We do not support Muhyiddin for UMNO Deputy President because he cannot be trusted. He has betrayed the Sultan Of Johor and the people of Johor by allowing Singaporeans to acquire land in Johor Bahru. If left unchecked, the whole of JB will be owned/controlled by the Singaporeans.

3. His Highness the Sultan Of Johor realized this and prevented Muhyiddin from further becoming the Mentri Besar of Johor.

4. We anticipate that all UMNO delegates will support the Abdullah-Najib leadership combination except for Johor.

5. From this, we can know that the UMNO in Johor is more aligned to Dr Mahathir and his cohorts.

Our Comment:

1. We strongly condemn Dr Mahathir for asking Abdullah to step down from being the Prime Minister. We will keep condemning him until he dies every time he asks Abdullah to step down.

2. Abdullah did not inherit a strong party but instead a corrupted party as a result of a corrupted leader or 'Indian Chief'. Who is this 'Indian Chief'? Dr Mahathir.

3. The people want a clean Government. The people do not want leaders like Dr Mahathir and his cohorts. Dr Mahathir is a 10% person. During his tenure, whatever projects that he could lay his hands on, he was not shy to ask for a 10% kickback.

Most people want leaders like Abdullah. Of course the Opposition wants Abdullah to step down because it is their job to do so. That is why we do not support the Opposition. We only support the truth irrespective of party politics.

Dr Mahathir is wrong in saying that when Abdullah steps down, the people will support BN again. The people will only support BN again if UMNO is clean and takes good care of the people. Not like how Dr Mahathir took care of the people. Even the BN component parties do not like UMNO during Dr Mahathir's era, which is corrupted to the core but they are too intimidated to voice out. Only his cohorts like him, irrespective of race.

4. Najib is right in supporting Abdullah. Dr Mahathir, do not discredit Najib. You are trying to get in between them, right?

5. Dr Mahathir is not wrong in appointing Abdullah as his successor. So Dr Mahathir, you do not need to pretend that you have made a mistake. We know your trick.

6. Dr Mahathir is squirming and feeling the heat now. Abdullah and his team are coming after his hide and Anwar and his team are also coming after his hide. We are also turning the screws. Just look at the VK Lingam tape scandal. This shows that everybody is coming after Dr Mahathir. And also look at the recent Anwar's police report on Musa Hassan and Abdul Ghani Patail. This case is also pointing to Dr Mahathir.

7. Anwar is not an American spy or an Israeli snitch. But, Dr Mahathir has made the Police's Information and Security system accessible to the Israelis. Who is the real spy now?

Our Comment:

1. When Dr Mahathir accused Anwar with sodomy and graft charges in 1998, we later found out that Anwar is innocent. Lee Kuan Yew accused Gopalan Nair of sedition when he allegedly called Judge Belinda a 'prostitute'. What a bully Lee Kuan Yew is.

2. The then IGP Rahim Noor brutally whack Anwar to near death during Dr Mahathir's era and he did not do anything about it. Gopalan Nair also suffered police brutality when he was arrested for this alleged sedition charge. What a coward these police officers are. One man against many.

3. During Operation Lallang, Dr Mahathir used his cohorts to put his adversaries under ISA detention. Although not as severe as Dr Mahathir's case, Lee Kuan Yew used his cohorts to beat up Gopalan in the streets. What a barbarian, worse than a gangster.

4. Watch out! Lee Kuan Yew has made his son the Prime Minister of Singapore. Dr Mahathir is following suite. So, what's the difference between Malaysia and Singapore then? Not much.

5. There shall never be peace in Singapore as long as she is not returned to Johor, Malaysia. Period.

Our Comment:

1. Dr Mahahtir cannot see anything good in what Abdullah is doing as right. He is overly consumed with hatred towards Abdullah that even the slightest common sense has escaped him. This is the characteristic of an insincere person. Let's say that Abdullah offers Dr Mahathir that Najib be the PM for just a few months and then his son Mukhriz can take over. We will see that Dr Mahathir will be the first one to jump sky high and clap his hands. Then only maybe he will say that Abdullah is right. But, we still doubt it, knowing his nature.

Abdullah is a righteous man while Dr Mahathir is not. Who can we believe? We will surely believe the words of Abdullah over Dr Mahathir. He is not fit to even be given the title of Tun. But, many citizens of Malaysia have been fooled. Even worse, they have fallen into the trap of Dr Mahathir's black magic of influencing people. Even the smarter and politically wary people have taken the bait.

2. A real, true and genuine statesman will not talk about his own party or BN per se, but would think of a wider picture on the safety and prosperity of the nation as a whole. Dr Mahathir is thinking of GE 13 already saying that BN will lose and so on and so forth. It does not matter to us who wins and loses, the most important issue is to save Malaysia from Dr Mahathir and his cohorts who want to destroy the nation with their personal agenda and greed.

For the record, during the last GE, UMNO used some black magic to influence people to vote for them. We destroyed this black magic and this is amongst the reasons why they did not do so well in the last GE. This is the standard practice of the Mahathir era. Do you believe us now?

3. It is Dr Mahathir that is "like a crab saying to its siblings to walk straight" but it itself cannot do so. We hope people can see right through him. There are many people who still support Dr Mahathir and this is amongst the reasons why our country cannot move forward and be a first world country. Corruption, nepotism, cronyism, invidualism, cannibalism, opportunism and whatever ism else they have up their sleeves, are the traits of Dr Mahathir and his cohorts. As long as they are around, alive and kicking, the country will not be safe and prosperous forever. We have to get rid of them once and for all. Only then will our country be safe, prosperous and blessed. We want our future generations to know this and not fall into the same traps of Dr Mahathir and his cohorts like for the past 20 or so years.

If Abdullah wants to unite UMNO by rounding them up, well, that is a good move and deed. Now, only Abdullah can cleanse UMNO of all the rots, talking about people specifically. Even Anwar failed to do it. We will support Abdullah in this initiative to the end. We do not want our future generations to suffer because of Dr Mahathir and his cohorts.

4. We do not support anyone who is against Abdullah, especially the UMNO members like Muhyiddin. They are on their own. In future, we will reveal some of the bad things he did for Johor. We know that many UMNO members do not support Abdullah behind his back. We would like to advise them that not to have such hypocrite characteristics. Be gentlemen and show support for Abdullah all the way, be it in front of him or behind him to everyone.

5. Since Tengku Razaleigh did not come to see us, we do not support him now. Although he is considered family, but the future of this country and the unity among the Muslims are more important than family ties, except that if there is treason to the DYMM SPB YDPA and/or the Malay Rulers. If that happens, there is no stopping us from coming out in full force until every single soul shall know the wrath of Allah s.w.t. When we say we are ready, we really mean what we say and there is no turning back. Not like some people who say one thing and then retract it. Our readiness is until the end of time (about 200 years or so). Period.
